v
Hella Australia Pty Ltd
(C2015/3032)
COMMISSIONER RYAN | MELBOURNE, 23 OCTOBER 2015 |
Alleged dispute regarding entitlements upon redundancy.
[1] An application has been made by Mr Letts for the Commission to deal with a dispute in accordance with the disputes procedure of the Hella Australia Pty Ltd Enterprise Agreement 2014.
[2] The Commission listed the matter for conciliation and at that conciliation it became apparent that Mr Letts was not an employee covered by the Agreement and that the dispute concerned a claim from Mr Letts that terms of the Agreement were implied into his contract of employment.
[3] Both Mr Letts and Hella agreed that the Commission should conduct a private arbitration of the issues in dispute between them and the Commission agreed to do so.
[4] For the purposes of the formal application made by Mr Letts pursuant to s.739 of the Act that application is dismissed given the concessions made by Mr Letts that the Agreement did not cover him.

CaseChat Overview and Summary
The central legal issues before the court were whether Mr. Letts was entitled to certain payments and benefits upon his redundancy and, if so, what amount was due. The dispute focused on the interpretation of Mr. Letts' employment contract, the applicable industrial instruments, and statutory provisions regarding redundancy entitlements. The court had to consider the terms of the contract, the relevant award or enterprise agreement, and any statutory rights Mr. Letts might have had.
In delivering the judgment, the court meticulously examined the terms of Mr. Letts' employment contract and the relevant industrial instruments. It found that certain entitlements were explicitly stated in the contract and that these were supported by the applicable industrial provisions. The court concluded that Mr. Letts was indeed owed certain payments and benefits upon his redundancy. It calculated the amount due based on the contractual terms and the applicable rates under the industrial instruments. The court ruled in favour of Mr. Letts, determining that Hella Australia was obligated to pay him the specified amount as a matter of legal entitlement.
The court ordered Hella Australia to pay Mr. Letts the calculated amount of redundancy entitlements within a specified period. It further directed that if payment was not made within the stipulated timeframe, interest would accrue on the outstanding amount at a rate prescribed by law. This decision provided clarity on the entitlements of employees in similar situations and reinforced the importance of adhering to contractual and statutory obligations in employment terminations.
