Alleged dispute regarding entitlements upon redundancy.

[1] An application has been made by Mr Letts for the Commission to deal with a dispute in accordance with the disputes procedure of the Hella Australia Pty Ltd Enterprise Agreement 2014.

[2] The Commission listed the matter for conciliation and at that conciliation it became apparent that Mr Letts was not an employee covered by the Agreement and that the dispute concerned a claim from Mr Letts that terms of the Agreement were implied into his contract of employment.

[3] Both Mr Letts and Hella agreed that the Commission should conduct a private arbitration of the issues in dispute between them and the Commission agreed to do so.

[4] For the purposes of the formal application made by Mr Letts pursuant to s.739 of the Act that application is dismissed given the concessions made by Mr Letts that the Agreement did not cover him.
