Anangu Pitjantjatjara Yankunytjatjara Land Rights (Miscellaneous) Amendment Act 2014

An Act to amend the Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Anangu Pitjantjatjara Yankunytjatjara Land Rights (Miscellaneous) Amendment Act 2014.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 19813Amendment of section 4 – Interpretation

Section 4(1)—after the definition of General Manager insert:

Independent Commissioner Against Corruption means the person for the time being holding, or acting in, the office of the Independent Commissioner Against Corruption under the Independent Commissioner Against Corruption Act 2012;

4Amendment of section 13O – Minister may suspend Executive Board
  1. (1)

    Section 13O(1)—delete subsection (1) and substitute:

    1. (1)

      The Minister may, for any reason he or she thinks fit, by notice in the Gazette, suspend the Executive Board for a period specified in the notice or until further notice in the Gazette.

    2. (1a)

      Subsection (1) (as enacted by the Anangu Pitjantjatjara Yankunytjatjara Land Rights (Miscellaneous) Amendment Act 2014) will expire 3 years after the day on which it comes into operation.

  2. (2)

    Section 13O—after subsection (2) insert:

    1. (3)

      An Administrator appointed under this section must, as soon as is reasonably practicable after each prescribed period of his or her appointment, prepare and submit to both Houses of Parliament a report on the operations of the Administrator and Anangu Pitjantjatjara Yankunytjatjara during the prescribed period.

    2. (4)

      In this section—

    prescribed period means—

    1. (a)

      if the Administrator is appointed for a period of less than 6 months—the period of the Administrator's appointment; or

    2. (b)

      in any other case—6 months.

5Amendment of section 19 – Unauthorised entry on lands

Section 19(8)—after paragraph (ba) insert:

  1. (bb)

    the Independent Commissioner Against Corruption, or an examiner or investigator, performing a function under the Independent Commissioner Against Corruption Act 2012; or
