By an expedited application, the applicant seeks special leave to appeal from a decision of the Court of Criminal Appeal of New South Wales (Payne JA, Fagan and Sweeney JJ) granting the applicant leave to appeal but dismissing an appeal from decisions of the District Court of New South Wales (T Smith SC DCJ).
The application is an inappropriate vehicle to examine the first special leave question and an appeal would not be in the interests of the administration of justice in this case. The second special leave question has insufficient prospects of success.
Special leave to appeal is refused.
