strect is of so steep a gradient that it is im])ossihle to construct and form the said intersecting and intersected streets in sucli a manner that each can he safely and comx'niently used and enjoyed as public roads and streets, hy foot-jiassengers upon the footpaths, and hy passengers with or Avithout horses, cattle, carriages, or other vehicles, upon the roadways or carriagoAvays thereof. And Avhereas it is expedient and necessary for the convenience of the public using them that the said streets should he constructed and formed so that the safe and convenient use of each of them should he not entirely interrupted. And Avhereas the said streets can he constructed and formed so that they may he safely and conveniently used and enjoyed hy the public as public roads and streets, over a part of their jii’csent width, without wholly interrupting the safe and convenient use of

either of them, hy slightly diverting the footpaths and roadways or carriageways of the said streets, and hy lessening the width of each respectively at and near the intersecting or meeting portions thereof, and hy altering the levels and directions of portions of the said streets. And whereas the Council of the said Borough cannot now lawfully divert the said footpaths and roadways or carriageways, or alter the levels thereof, in such a manner as would he necessary for the pur poses aforesaid. Be it therefore enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South "VYales in Parliament assembled, and by the authority of the same, as follows :—^
| Powers of Council. | 1. I t shall he lawful for the Council of the said Borough to |
alter and lessen the Avidth of the footpaths or carriagcAvays or road ways of the said streets, or both the footpaths and the carriageways or roadways thereof, at and within a reasonable distance from their meet ing or intersection, and to raise or lower the level of part of the said streets for a portion of the width of the said streets, and to divert the
| ■ | course of the said streets, and to build and maintain retaining walls, and make and maintain embankments and excavations upon, in, or across the said streets, and to do all other necessary Avork therein or thereupon at and Avithin a reasonable distance from such intersection or meeting, although the existing course of the footways or roadAvays or carriagcAÂ ays of such streets may thereby be obstructed or interrupted, or their Avidth lessened or their levels altered. P'rovided that at least one footpath of not less than six feet in Avidth, and a carriageAvay or roadAvay of not less than twenty-five feet in width, shall be made, con tinued, and maintained from each of the said meeting or intersecting streets into each of the said met or intersected streets for the free use and enjoyment thereof as public roads and streets, by foot- passengers of the footAvays thereof, and by passengers with or Avithout horses, cattle, carriages, or A'ehicles of any kind of the roadways or CarriagCAÂ ays thereof. Provided also that when Perkins-street shall bo diverted from its present course, at its junction with Church-street, as herein permitted, the roadAvay or carriagcAÂ ay of Church-street shall be maintained in the same direction as before such diversion, and shall not be lessened in width by more than one-half of the AA'idth of the existing roadAAmy or carriagcAvay thereof. |
| Alteration of streets. | 2 . The diversion or alteration of the said streets, or either of |

| Short title. | 3. This Act may be cited as the “ (Newcastle) Church and Perkins Streets Act.” |
