The applicant seeks an extension of time within which to seek special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Macaulay JA and J Forrest AJA). The Court of Appeal dismissed an application for leave to appeal from a decision of McDonald J which dismissed an appeal by the applicant from a decision of Irving AsJ which had granted summary judgment on an appeal from a decision of the Victorian Civil and Administrative Tribunal. The proposed grounds of appeal relied upon by the applicant in the further proposed amended application for special leave have insufficient prospects of success to warrant the grant of special leave to appeal. The applications to amend and further amend the application for special leave should be granted but an extension of time within which to seek special leave would be futile and should be refused.
Special leave to appeal is refused.
