Application for approval of the A MURDER IS ANNOUNCED Performers’ Collective Agreement.

[1] An application has been made for the approval of an enterprise agreement known as the A MURDER IS ANNOUNCED Performers’ Collective Agreement (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single enterprise agreement made as referred to in s.172(2)(b) of the Act (a greenfields agreement).

[2] The Media, Entertainment and Arts Alliance has provided a declaration in support of the application for the approval of the Agreement (see s.185 of the Act).

[3] It is noted that the National Employment Standards prevail over any inconsistent provisions in the Agreement that are less beneficial to employees. It seems that this will ensure that annual leave loading is paid upon termination (see s.90(2) of the Act).

[4] I am satisfied that each of the requirements of ss.172, 186, 187 and 188 that are relevant to this application for approval have been met.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 26 April 2013. The nominal expiry date of the Agreement is 31 December 2013.
