The primary legal issue before the Court was whether the proposed trade mark "MEMBER ADVANTAGE" was deceptively similar to the existing trade mark "ADVANTAGE" for the purposes of the *Trade Marks Act 1995* (Cth). This required the Court to consider the degree of visual, phonetic, and conceptual resemblance between the two marks, as well as the similarity of the goods and services in relation to which they were used, and the likely perception of the relevant consumer.

Justice Kirov applied the established principles for assessing deceptive similarity, including the "imperfect recollection" test and the consideration of the marks as a whole. His Honour found that while the word "ADVANTAGE" was common to both marks, the addition of the word "MEMBER" to Member Advantage's mark created a significant distinction. Furthermore, the services offered by Member Advantage, particularly the operation of loyalty programs, were sufficiently different from American Airlines' core business of air travel to reduce the likelihood of confusion. The Court concluded that the marks, when considered in their entirety and in the context of the respective services, were not deceptively similar.

Consequently, the appeal was dismissed, and the registration of the trade mark "MEMBER ADVANTAGE" was allowed.
