R E G U L A T I O N S t

1. Regulation 2 of the Weights and Measures (Packaged Goods) Regulations is amended by omitting the word and figures " (Regulations 5-21) " and inserting in their stead the word and figures " (Regulat ions 5-21 A ) ".

2 . Regulation 3 of the Weights and Measures (Packaged Goods) Regulations

is a m e n d e d —
(a) by inserting in sub-regulation ( 1 . ) , after the definition of " lubricating oil ", the following definition:—

" main display p o r t i o n " , in relation to a package, means that portion of a package on which the name or brand of the article contained in the package is shown, o r —

(a)

where the name or brand is shown on two or more port ions of a package—the port ion on which it is most prominently shown; or

(b)

where the name or brand is shown on two or more portions of a package in the same prominence—any one of those port ions;"; and

(b) by inserting in that sub-regulation, after the definition of " peas ", the
following definit ion:—

" ' poultry ' includes pigeons and pheasants;" .

3 . Regulation 4 of the Weights and Measures (Packaged Goods) Regulations

is a m e n d e d —

(a)

by inserting in sub-regulation ( 1 . ) , before the words " t h e First Schedule ", the words " Part I. or Par t I I . of " ;

(b)

by inserting in sub-regulation (2.), before the words "the First Schedule ", the words " Part I. or Part II. of " ;

( c ) by inserting in paragraph (a) of sub-regulation ( 3 . ) , before the

words " the First Schedule ", the words " Par t I . or Par t II . of ";

(d)

by omitting paragraphs (b), (c), (d), (e), (i), (/), (k) and (n) of that sub-regulation;

(e) by omitting paragraphs (p) and (<?) of that sub-regulation and
inserting in their stead the following word and p a r a g r a p h : —

" and (p ) a package containing a number of individual servings of

an article, w h e r e —

(i)    each serving is of a quantity less than the quan­ tity specified, in relation to that article or the class of articles in which that article is included, in Co lumn B of Par t I. or Par t II . of the First Schedule; and

(ii)   there is marked on the package the number of individual servings contained in the package and the total weight or measure of the contents of the package." ; and

( / ) by adding at the end thereof the following sub-regulat ion:—

" (4 . ) Where an article is specified in Column A of Par t I. and in Column A of Part II . of the First Schedule—

(a)

the units of measurement specified in Columns B, C and D of the item relating to that article in Part I., o r the metric units of measurement specified in those columns in Par t II . , of that Schedule may be marked on the package containing the article; and

(b)

the same units of measurement shall be marked on a package containing an article as are used in relation to that article." .

4. Regulat ion 7 of the Weight'; and Measures (Packaged Goods) Regulations

is a m e n d e d —
(a) by omitting sub-paragraph (i) of paragraph (a) of sub-regulation
(1 . ) and inserting in its stead the following p a r a g r a p h : —

" ( i ) be on the main display portion of the package and, where the package is of such shape or design that one or more port ions of the package, other than the main display portion, is likely to be displayed when the article is exposed for sa le—on that port ion or on one of those other portions, as the case may

be;" ;
(b) by omitting sub-paragraphs (iii) and (iv) of paragraph (b) of sub- regulation (1.) and inserting in their stead the following sub­ p a r a g r a p h s : —

" (iii) shall, in the case of a package that is cylindrical or oval or substantially cylindrical or oval, be placed within the, segment of the package subtended horizontally by an angle of one hundred and twenty degrees a t the centre of the per­ pendicular axis of the package;

(iv)    shall be in the English language and, subject to these Regu­ lations, shall be expressed either in Commonwea l th legal units of measurement related to the yard, the pound or the gallon or in terms of the metr ic system of measurement related to the metre , the g ramme o r the litre; and

(v)     shall not be obscured or crowded by any other printed or graphic mat ter . " ;

(c) by inserting in paragraph (a) of sub-regulation (2.), after the words

" two fluid o u n c e s " , the words " or 75 g rammes or 7 5 millilitres " ;

(d) by omitting sub-paragraphs (ii) and (iii) ot paragraph (a) of sub-
regulation (3 . ) and inserting in their stead the following
p a r a g r a p h s : —
" (ii) consisting of cake, fruit o r vegetables contained in a single

package;

(iii)   consisting of a roll of ribbon, lace, elastic or any other article of haberdashery; o r

(iv)    packed in a plain package and sold to the purchaser on the premises upon which it is packed ," ;

(e) by omitting from paragraph (b) of sub-regulation (8.) the words " in terms of the metr ic system " and inserting in their stead the words " in terms of the metric system of measurement related to the metre , the g ramme or the litre "; and

( / ) by omit t ing sub-regulations (9 . ) and (10 . ) and inserting in their stead the following sub-regulation:—<

" ( 9 . ) T h e provisions of sub-regulation (1 . ) of this regulation apply to and in relation to the mark ing o n a package containing an article of the statements required to be marked pursuan t t o regulation 18, 19, 21 o r 2 1 A of these Regulations.".

5. Regulat ion 9 of the Weights and Measures (Packaged Goods) Regulations

i i a m e n d e d —
(a) by omitting from sub-regulation (1.) the words "a unit of measure­ ment of the metric system,";
(b) by adding at the end of that sub-regulation the words " or in terms of the tonne, k i logramme, g r amme o r mil l igramme " ;
(c) by adding at the end of paragraph (a) of sub-regulation (2.) the words " or in terms of the tonne, k i logramme, g ramme or mil l igramme ";
(d) by omitting paragraphs (c) and (d) of that sub-regulation and
inserting in its stead the following p a r a g r a p h s : —

" (c ) subject to the next succeeding paragraph, where the weight or measure of an article is expressed in te rms of the metric system of measurement and in terms of units of measure­ ment related to the yard, the pound and the gal lon—

(i)   fractions of a unit of measurement related to the yard, the pound or the gallon may be expressed in decimal sub-multiples of that unit; and

(ii)    decimal sub-multiples of a unit of measurement of the metric system of measurement may be expressed in fractions of that unit;

(d)

where fractions of a unit of measurement related to the pound may, in pursuance of the last preceding paragraph, be expressed in decimal sub-multiples of that unit , decimal sub- multiples of an ounce may be expressed in terms of hundredths of an ounce for quantities not greater than four ounces and in tenths of an ounce for quantities greater than four ounces but less than one pound;" .

6. Regulat ion 10 of the Weights and Measures (Packaged Goods) Regulations

is a m e n d e d —
(a) by omitting from sub-regulation (1.) the words "in terms of a unit

of measurement of the metric system or ";

(b)

by adding at the end of that sub-regulation the words " or in terms of the cubic metre , cubic decimetre or litre, or cubic centimetre or milli- li tre "; and

(c) by omitting sub-regulation (3.) and inserting in its stead the following

sub-regula t ions :—

" (3 . ) Where the volume of an article is expressed in te rms of units of measurement related t o the gallon and in units of measurement related to the litre, fractions of a unit of measurement related to the gallon may be expressed in decimal sub-multiples of that unit.
" (4 . ) Where the volume of an article is expressed in terms of units of measurement related to the cubic foot and in terms of a metr ic unit of volume, fractions of a unit of measurement related t o the cubic foot may be expressed in decimal sub-multiples of that unit ." .

7. After regulation 10 of the Weights and Measures (Packaged Goods)

Regulations the following regulation is inser ted :—

" 10A . Where the weight or measure of an article to which section 8 of the Ordinance applies is marked on the package containing the article by reference to a decimal sub-mult iple—

(a) the decimal sub-multiple shall not be expressed to more than three

significant figures; and

(b)

the decimal point that indicates the sub-multiple shall be preceded by zero o r by a numera l . " .

8. Regulat ion 11 of the Weights and Measures (Packaged Goods) Regulations

is a m e n d e d —
(a) by omitting from paragraph (a) of sub-regulation (2.) the words " o r the yard " and inserting in their stead the words ", yard, kilo­ gramme, cubic decimetre, litre or metre ";
(b) by omitting from paragraph (d) of sub-regulation (2.) the words " and an additional s tatement stating the quant i ty in fluid ounces m a y be added " ;
(c) by omitting pat igraph (/) of that sub-regulation and inserting in
its stead the fol l jwing p a r a g r a p h : —

" ( / ) in any case, the package containing an article may be marked with an addit ional s tatement stating the quant i ty of the article in fluid ounces ." ; a n d

(d) by adding at the end thereof the following sub-regulat ions:—

" (3 . ) Subject to the next succeeding sub-regulation, where the

quanti ty of an article is expressed in terms of a uni t of
measurement of the metric system, the statement of weight or measure used in relation to the article may be expressed in terms of a uni t of weight o r measure specified in the Firs t Co lumn of the table in this sub-regulation if the weight or measure so expressed is no t greater that the weight or measure specified in the Second Co lumn of the table opposite to the first-mentioned weight or measure .

" (4 . ) Notwithstanding the provisions of the last preceding sub- regulation, the measure of paper lengths may be expressed in milli­ metres if the measure so expressed is not greater than ten thousand millimetres.".

is amended—

(a) by omitt ing the table in sub-regulation (1 . ) and inserting in its stead

" ( 7 . ) Where , pursuant to section 11 or section 12 of the Ordinance, a package may be marked with the words ' Net weight when packed ' or ' Net weight at s tandard condition the provisions of sub-regulations ( 1 . ) , ( 2 . ) , ( 3 . ) , (5 .) and (6 . ) of this Regulation apply to the manner in which those words may be marked on the

package.
" (8.) The provisions of sub-regulations ( 1 . ) , ( 2 . ) , ( 4 . ) , (5 .) and

(6 . ) of this regulation apply to and in relation to the marking on a package containing an article of the price per pound or per kilo­ gramme of the article pursuant to regulation 18 of these Regulations.

" (9 . ) T h e preceding provisions of this regulation do not apply to additional statements of the weight o r measure of an article that are marked on the package containing the article pursuant to para­ graph (b) of sub-regulation (8 . ) of regulation 7 of these Regulat ions." .

10. Regulat ion 13 of the Weights and Measures (Packaged Goods) Regulations

{a) by omitting from paragraph (b) of sub-regulation (1.) the word

( 6 ) by omit t ing paragraph (c ) of that sub-regulation and inserting in its

1 1 . Regulat ion 14 of the Weights and Measures (Packaged Goods) Regulations

is amended by omitt ing sub-regulation (2 . ) and inserting in its stead the following

sub-regula t ions :—

" (2 . ) Notwiths tanding the last preceding sub-regulation, a s ta tement of the

weight of a number of eggs contained together in a package may be expressed—

(a) in terms of the minimum weight of the lightest egg contained in the
package ; o r

(b)

in terms of two weights between which the weight of each egg contained in t he package falls.

" (3 . ) Notwithstanding sub-regulation (1 . ) of this regulation, a s tatement of the weight of dressed poultry may be expressed in terms of a min imum net weight and, where the weight is so expressed, the statement shall include the size number of the poultry, being the size number specified in the second column of the Fifth Schedule opposite to the min imum net weight specified in the first column of that Schedule.

" (4 . ) T h e size number marked on a package containing dressed poultry in pursuance of the last preceding sub-regulation shall be marked in figures of a size not less than 10 millimetres.
" (5 . ) T h e last two preceding sub-regulations do not apply to cooked poultry or to dressed poultry that has been detached from the carcass.".

12 . Regulat ion 18 of the Weights and Measures (Packaged Goods) Regulations is amended—

(a)

by omitting sub-regulation (1.) and inserting in its stead the following sub-regula t ion:—

" (1 . ) Subject to this regulation, a package containing pre-packed
meat , natural cheese, dressed poultry, fish (including Crustacea), un -
sliced bacon, ham or smallgoods shall, before being exposed for sale,
be m a r k e d —

(a)

with a statement of the price per pound or per kilogramme of the article; and

(b)

where the package contains more than one article, with a s tatement of the price per pound or per ki logramme of each of the articles contained in the package." ;

(b) by inserting in sub-regulation ( 2 . ) , after the word " pound " the words " or per k i logramme ";
(c) by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

" (3 . ) Sub-regulation (1 . ) of this regulation does not apply to or in relation to an article if—

(a) a statement of the price per pound or per kilogramme of the

article is indicated by a prominent s tatement in letters of a size of not less than Ten millimetres placed on or imme­ diately adjacent to a tray in or on which there are displayed

packages containing that article;

(A) the article consists of—

(i) frankfurts;

( i i ) minced meat ;

(iii) sausage meat ;

( iv)     sausages;

( v )     saveloys;

(vi) sliced cooked meat ; or
(vii) sliced bacon,

packed in net weights of two ounces, four ounces, six ounces, eight ounces, twelve ounces, one pound , one and one-half pounds or in multiples of one pound, or in net weights of fifty grammes, one hundred grammes, one hun­ dred and twenty-five grammes, two hundred grammes, two hundred and fifty grammes, three hundred and seventy-five grammes, five hundred grammes or in multiples of five hundred grammes;

(c)

the article consists of natural cheese packed in net weights of four ounces, six ounces, eight ounces, twelve ounces, one pound, one and one-half pounds or in multiples of one pound or in net weights of one hundred grammes , two hundred grammes, five hundred grammes or in multiples of five hundred grammes;

(d) the article consists of frozen fish;

(e) the article consists of dressed poultry the statement of the weight of which is expressed to be a min imum weight; or

( / ) the article is packed to a net weight of one pound or an integral multiple of one pound, or one ki logramme o r an integral multiple of one ki logramme." .

13. Regulat ion 19 of the Weights and Measures (Packaged Goods) Regula­

tions is a m e n d e d —
(a) by inserting in sub-regulation ( 1 . ) , after the word " t o n " (wherever

occurr ing) t he words " or one tonne " ; and

(b)

by adding at the end of sub-regulation (2.) the words " or twenty- five ki logrammes " .

14. After regulation 21 of the Weights and Measures (Packaged Goods)

Regulations the following regulation is inserted in Part I I I . : —

" 2 1 A . — ( 1 . ) I n this regula t ion—

' Class A fibre' means a fibre consisting of woo! or o ther animal fibre, viscose or cup rammon ium rayon or a mixture of any two or m o r e of those fibres;

' Class B fibre' means a fibre consisting of silk, cotton or cellulose

acetate o r a mixture of any two or more of those fibres;

' Class C fibre' means a fibre or a mixture of fibres other than a Class A

fibre o r a Class B fibre;

' cot ton w o o l ' includes cotton wool made from fibres other than cot ton .

" (2 . ) Y a r n and cot ton wool are declared t o be articles that are, for the

purposes of section 12 of the Ordinance , articles that may be packed in a package
marked " N e t weight at s tandard condit ion " or words to the like effect.

" (3 . ) Subject to sub-regulation (5.) of this regulation, the number specified in Co lumn 2 of the Four th Schedule opposite to a class of fibre specified in Co lumn 1 of that Schedule is prescribed for the purposes of paragraph ( c ) of sub-section (4 . ) of section 12 of the Ord inance .

" (4 . ) Subject t o sub-regulation (6 . ) of this regulation, the number specified in Co lumn 3 of the Four th Schedule opposite to a class of fibre specified in Column 1 of that Schedule is prescribed for the purposes of paragraph (ft) of sub-section (5 . ) of section 12 of t he Ordinance .

" ( 5 . ) (a ) yarn or cotton wool is composed of a mixture of fibres; and W h e r e —

(6 ) the mixture consists of fibres of any two or more of Class A fibres, Class B fibres or Class C fibres,

the number prescribed for the purposes of paragraph (c ) of sub-section (4 . ) of section 12 of the Ordinance is the number ascertained by adding 5 to the number ascertained in accordance with the fo rmula—

A X 6 + B X 2,

w h e r e —

A is the propor t ion by weight that the Class A fibre or total of the Class A fibres of which the cotton wool o r yarn is composed bears to the total weight of that cotton wool or yarn; and

B is the proport ion by weight that the Class B fibre or total of the Class B fibres of which the cotton wool or yarn is composed bears to the total weight of that cot ton wool o r yarn.

" ( 6 . ) (a ) yarn or cotton wool is composed of a mixture of fibres; and W h e r e —
(b) the mixture consists of fibres of any two or more of Class A fibres, Class B fibres or Class C fibres,

the number prescribed for the purposes of paragraph (b) of sub-section (5 . ) of section 12 of the Ordinance is the number ascertained in accordance with the formula—

A X 6 + B X 2 ,

where A and B have the same respective meanings as in the last preceding
sub-regulation.

" (7 . ) A package containing an article declared by sub-regulation (2.) of this regulation to be an article to which section 12 of the Ordinance applies shall also be marked with a statement of the proport ion by weight of each of the fibres of which the article contained in the package is composed.".

15. Regulation 22 of the Weights and Measures (Packaged Goods) Regulations is repealed and the following regulation is inserted in its s t e a d : —

" 2 2 . — ( 1 . ) Subject to the next succeeding sub-regulation, an expression that

is marked on a package containing a pre-packed article (other than an article referred t o in item 4 or 5 of the Second Schedule) is a prohibited expression for the purposes of section 15 of the Ordinance if it relates to the contents of the pre-packed article or the package and consists of or includes the word ' gross ' or the words ' gross we igh t ' or words to the like effect.

" (2 . ) Sub-regulation (1 . ) of this regulation does not apply to a package

w h e r e —

(a)

the gross weight of the package exceeds ten pounds or four kilo­ grammes;

(b)

the net weight of the contents of the package is marked on the package; and

(c ) the words ' for transport only ' are marked on the package." .

16. Regulation 25 of the Weights and Measures (Packaged Goods) Regulations is amended by omitting the word " T h i r d " and inserting in its stead the word " Second ".

17. After regulation 25 of the Weights and Measures (Packaged Goods) Regulations the following regulation is inserted:—

" 25A . Noth ing in Part II . of these Regulations applies to or in relation to an

article described in, or included in a class of articles described in, i tems 1, 7, 9
and 27 of the Second Schedule.".

18. T h e First and Second Schedules to the Weights and Measures (Packaged Goods) Regulat ions are repealed and the following Schedules inserted in their s tead:—

REGULATION 24

4. Wheat, maize, oats, chaff, potatoes and other agricultural produce of a like nature, if
sold by weight in sacks of more than 60 pounds, or 25 kilogrammes, gross weight

5.           Confectionery, dried fruits, nuts, popcorn, potato crisps and savouries—

(i)  in a package of less than 3 ounces, or 85 grammes, gross weight or, in the case of chocolate moulded in slab, block or bar form with or without added matter, less than 1 ounce or 30 grammes gross weight;

(ii)   packed on premises for sale on those premises, if—

(A) the package is displayed for sale on those premises in a receptacle bearing

a prominent statement, in letters and figures not less than 10 millimetres in

height, of the weight and price of contents of the package; and

(B) the gross weight of the package does not exceed 8 ounces or 250 grammes

or the sale price of the package does not exceed 20 cents; or

(iii)  packed in, or together with, another article if the substantial value of the combined articles is represented by that other article

6.           Confectionery in novelty shapes, including easter eggs

7.           Goods (other than powdered milk and condensed milk, whether flavoured or not) contained in a package on which there is set out a direction that the entire contents of the package, or each of a stated number of smaller packages contained in the package are to be diluted to a stated weight or measure, including—

(i)  jelly crystals, blancmange powders, custard powders, junket tablets and junket powders;

(ii)   photographic developers and fixers and chemicals packed for use in connexion with photography;

(iii) chemicals packed for agricultural or horticultural use; and
(iv) legume seed innoculants

8.           Honey in the comb, being honey contained in the original frames

9. Liquid colouring materials contained in a package on which is set out a direction that
the entire contents of the package are to be mixed with a stated volume of paint of
a type specified in the instructions, where the measure of the contents of the package is not more than ten parts per centum of that stated volume

10.           Goods for therapeutic use, being—

(i)   goods compounded or made to the order of the purchaser of the goods or of a medical practitioner, dentist or veterinary surgeon; or

(ii)  goods the supply of which otherwise than on the written prescription of a medical practitioner, dentist or veterinary surgeon is an offence against a law in fore* in the Territory

11.           Ice cream and other frozen confections contained in packages of less than 10 fluid

ounces or 300 millilitres

12.           Paint and paint colouring agents contained in packages of less than 3 ounces or

25 grammes, or 3 fluid ounces or 25 millilitres

13.           Toilet and medicinal preparations packed in cake or tablet form for use in washing

or as a personal deodorant

14.           Any article, other than drugs, dried vegetables (including freeze-dried vegetables), pepper and other spices, herbs, instant tea, tobacco or yarns, contained in a package of less than 1 ounce or 25 grammes, or 1 fluid ounce or 25 millilitres, net weight

15.           A pie or pastry made for use as an individual serve the weight of which is less than

8 ounces or 250 grammes

16.           Cakes, sponges and puddings, if packed singly in packages of less than 4 ounces, or

(ii)  by number in quantities of more than 480 sheets in wrapping applied to the paper at the mill at which it was produced and marked with the number of sheets contained in the wrapping and with the dimension of each sheet
