Regulations under the Public Health Ordinance 1928-1975.*

I, D O U G L A S N I X O N E V E R I N G H A M , the Minister of State for Heal th , hereby
make the following Regulations under the Public Health Ordinance 1928-1975.

A M E N D M E N T S O F T H E P U B L I C H E A L T H ( D A I R Y ) R E G U L A T I O N S !

1. Regulation 37 of the Public Heal th (Dairy) Regulations is amended by omit t ing sub-regulation (3) and substituting the following sub-regulat ion:—

" ( 3 ) A person shall not , in the course of a business carried on by him, engage in the carriage or delivery of milk or cream between the hour of six o'clock in the morning of a day and the hour of five o'clock in the afternoon of the same day unless—

(a) he is a licensed dairyman engaged in the carriage or delivery of milk or cream in the course of his business; or
(b) the vehicle used by him for that carriage or delivery is so constructed
or equipped that the milk or cream carried in it is kept at a tempera­
ture of not more than 10 degrees Celsius.".

2. Regulation 82 of the Public Health (Dairy) Regulations is repealed and the following regulation subst i tuted:—

" 8 2 . ( 1 ) A person shall not engage in the retail distribution of milk or cream
from a vehicle to houses or flats or both between the h o u r of six o'clock in the

morning of a day and the hour of five o'clock in the afternoon of the same day.

Authorised by the ACT Parliamentary Counsel—also accessible at

" (2 ) The occupier of a factory shall not deliver milk or cream to a retail milk distributor, or to a person on behalf of a retail milk distributor, between the hour of six o'clock in the morning of a day and the hour of five o'clock in the afternoon of the same day.
" ( 3 ) It is a defence to a prosecution for an offence against sub-regulation (2 ) that the defendant had reasonable grounds for believing that the milk was required by the person to whom it was delivered for his own use or the use of a member of his family.".
