Regulations under the Public Health Ordinance 1928 1

I, RALPH JAMES D U N N E T H U N T , the Minister of State for Health, hereby make the following Regulations under the Public Health Ordinance 1928.

A M E N D M E N T S OF THE PUBLIC HEALTH
(BOARDING-HOUSES) REGULATIONS 2

1. Regulation 3 of the Public Health (Boarding-houses) Regulations is amended by omitting from the definition of "Boarding-house" in sub- regulation (1) all the words after "thereof," (where first occurring) and substituting " in which a person, not being a member of the family of the proprietor, is lodged or boarded for hire or reward.".

2. Regulation 4 of the Public Health (Boarding-houses) Regulations is amended by adding at the end thereof the following sub-regulations:

" ( 2 ) In proceedings for an offence against sub-regulation (1), it is a defence that—

offence.".
(a) the number of persons lodged or boarded for hire in the boarding-house to which the proceedings relate on the date of the alleged offence did not exceed 2; and
(b) the number of persons lodged or boarded for hire in that boarding-house at the same time did not, at any time during the period of 12 months immediately preceding the date of the al­ leged offence or the relevant period, whichever is the shorter, exceed 2.

" ( 3 ) For the purposes of sub-regulation (2), 'relevant period' means the period that commenced at noon on the day on which the de­ fendant first acted as the proprietor of the boarding-house and ended on the expiration of the day immediately preceding the date of the alleged
