Regulations under the Poker Machine Control Ordinance 1975.*
I, A N T H O N Y A L L A N STALEY, the Minister of State for the Capital Terr i tory, hereby make the following Regulat ions under the Poker Machine Control

Ordinance 1975.

A M E N D M E N T S O F T H E P O K E R M A C H I N E R E G U L A T I O N S !

1. Regulation 5 of the Poker Machine Regulations is amended by omit t ing

the words " the Schedule " and substituting the word and figure " Schedule 1 ".

2 . After regulation 7 of the Poker Machine Regulations the following

regulation is inser ted :—

" 8. T h e procedure for the purchase of poker machines by the Board is as set

out in Schedule 2." .

3 . T h e Schedule to the Poker Mach ine Regulations is amended by omit t ing

the w o r d —

" S C H E D U L E "

and substituting the word and figure—

" S C H E D U L E 1 ".

4 . The Poker Machine Regulations are amended by adding at the end thereof

P R O C E D U R E F O R P U R C H A S I N G P O K E R M A C H I N E S
1. ( 1 ) F o r the p u r p o s e of inv i t ing t enders for the supp ly o f p o k e r m a c h i n e s , the Registrar
shall c a u s e a no t i ce of inv i ta t ion t o tender t o b e p u b l i s h e d i n —
( a ) a n e w s p a p e r p u b l i s h e d and c i rcu la t ing i n the Terri tory; and
( b ) a n e w s p a p e r p u b l i s h e d and c irculat ing i n the State o f N e w S o u t h W a l e s ,
and m a y c a u s e the n o t i c e to b e p u b l i s h e d in a n e w s p a p e r p u b l i s h e d and c ircu la t ing in s u c h
o t h e r p l a c e ( w h e t h e r in Aus tra l ia or e l s e w h e r e ) as the B o a r d th inks fit.
( 2 ) T h e no t i ce referred to in sub-c lause ( 1 ) shall s p e c i f y —
( a ) the types and , in respect o f e a c h type , the n u m b e r of p o k e r m a c h i n e s for the
supply o f w h i c h tenders are inv i ted;
(b) the date and the time on that date until which tenders will be received by the

(c) the address at or to which tenders may be lodged or sent; and

(d)

the place at which and the times during which the documents referred to in clause 3 may be obtained,

and may contain such other information as the Board thinks fit.

(3) The date referred to in paragraph (2) (b) shall be a date not earlier than 21 days

after the date on which sub-clause (1) is complied with.

2. A notice referred to in sub-clause 1 (1) may relate to poker machines to be purchased

for more than 1 club.

3. (1) Where a notice of invitation to tender is, in accordance with sub-clause 1 (1 ) , published in a newspaper, the Registrar shall, at the request of a person, furnish to the person a form of tender and notice of general conditions of tender.

(2) The form referred to in sub-clause (1) shall be in such form as is approved by the

Board.

(3) The notice referred to in sub-clause (1) shall contain details of—

(a) the conditions with which a tenderer is required to comply; and

(b)

the terms of the contract that a successful tenderer will be required to enter into with the Board,

and may contain such instructions and information relating to the preparation and submission
of tenders as the Board thinks fit.

4.  The Board shall consider a tender submitted to it in respect of—

(a)

a number of poker machines that is equal to the number of poker machines referred to in a notice of invitation to tender; or

(b) a number of poker machines that is less than that number.

5. (1) The Board may accept a tender either wholly or in part.

(2) The Board may accept a tender by notice in writing given to the tenderer.

(3) Where the Board decides not to accept a tender, the Board shall notify the tenderer

in writing of its decision.
