Regulations under the Motor Omnibus Services Ordinance 1955.*

I, ANTHONY ALLAN STALEY, the Minister of State for the Capital Territory, hereby make the following Regulations under the Motor Omnibus Services Ordin­ ance 1955.

AMENDMENTS OF THE MOTOR OMNIBUS SERVICES REGULATIONS!

1. These Regulations shall come into operation on 13 September 1976.

2. Regulation 3 of the Motor Omnibus Services Regulations is amended—

(a)

by inserting in sub-regulation (1), after the definition of " omnibus ", the following definition:—

" ' period ticket' means—
(a) a daily ticket;
(b) a weekly ticket;
(c) a monthly ticket; or

(d) a term ticket,

sold under the Ordinance;"; and

(b) by omitting sub-regulation (2) .

3. Regulation 13 of the Motor Omnibus Services Regulations is amended—

and 1975, Nos . 2 and 28.
(a) by omitting from sub-regulation (2) the words "the last preceding sub-regulation " and substituting the word and figure " sub-regulation (1) "; and
(b) by omitting from sub-regulation (2) the words " (c) of that sub- regulation" and substituting the figure and letter " (1) (c) ".

4. Regulation 15 of the Motor Omnibus Services Regulations is amended—

(a)

by omitting from sub-regulation (3) the words "daily or a monthly ticket" and substituting the words " period ticket or who has pur­ chased a book of tickets sold under the Ordinance "; and

(b)

by inserting in sub-regulation (3), after the word "ticket" (last occurring), the words " or on tendering a ticket or tickets taken from that book of tickets ".

5. Regulation 16 of the Motor Omnibus Services Regulations is amended—

(a)

by omitting from sub-regulation (2) the words "the last preceding sub-regulation " and substituting the word and figure " sub-regulation

( l ) ";

(b)

by omitting from paragraph (2A) (a) the words " daily or a monthly " and substituting the word " period ";

(c) by omitting from paragraph (2A) (b) the words " of this regulation ";

(d)

by omitting from paragraph (2A) (C) the words "his daily or monthly " and substituting the word " that ";

(e)

by inserting in sub-regulation (2A), after the word " shall ", the words ", subject to sub-regulation (2c),";

(f) by inserting after sub-regulation (2A) the following sub-regulations:—

" (2B) Where—

(a)

a person who has purchased a book of tickets sold under the Ordinance is entitled to travel, on tendering a ticket or tickets taken from that book of tickets, without payment of the fare otherwise applicable;

(b) a demand is made of that person under sub-regulation
(1) ; and

(c)

the person produces for inspection the counterfoil of the ticket or of each of the tickets taken from that book and tendered in respect of that travel,

that person shall, subject to sub-regulation (2c) , be deemed to have
complied with the demand.

" (2c) Where, pursuant to a demand under sub-regulation (1) , a person produces for inspection—

(a)

a monthly ticket purchased at a concessional price in accord­ ance with sub-section 4c (2A) of the Ordinance;

(b) a term ticket; or

(c)

the counterfoil of a ticket or tickets taken from a book of tickets purchased at a concessional price in accordance with sub-section 4CA (3) of the Ordinance,

the person shall, at the request of the person making the demand, also produce for inspection a student card issued to him under the Ordinance or an identity card issued to him by a tertiary education
institution and, where he fails to do so, that first-mentioned person
shall not be deemed to have complied with the demand.

" ( 2 D ) Where a demand is made under sub-regulation (1) of a person referred to in a paragraph of sub-regulation 10(1 ) of the Motor Omnibus Fares Regulations and—

(a)

in the case of a person referred to in paragraph 10 (1) (a) of those Regulations—a person apparently of or over the age of 8 years, being a person in whose care and custody the first- mentioned person apparently is, assures the person making the demand that the first-mentioned person is under the age of 5 years;

(b)

in the case of a person referred to in paragraph 10 (1) (b) of those Regulations—the person produces the written evidence referred to in paragraph 10 (2) (b) of those Regulations;

(c)

in the case of a person referred to in paragraph 10 (1) (c) of those Regulations—the person assures the person making the demand that he is—

(i) a blind person; or

(ii) accompanying a blind person as an attendant; and

(d)

in the case of a person referred to in paragraph 10(1) (e) of those Regulations—the person produces the written evidence referred to in paragraph 10 (2) (d) of those Regulations,

the first-mentioned person shall, subject to sub-regulation (2F ) , be

deemed to have complied with the demand.

" (2E) A person shall not falsely assure a person who makes a

demand under sub-regulation (1) that—

(a)

a person apparently in his custody or control is under the age of 5 years;

(b) he is a blind person; or

(c) he is attending a blind person as an attendant.

" (2F) Where a person is convicted of an offence under sub-

regulation ( 2 E ) —

(a)

where the person is convicted in relation to an assurance that a person apparently in his custody or control is under the age of 5 years—that last-mentioned person; or

(b)

where the person is convicted in relation to an assurance that he is a blind person or a person attending a blind person as an attendant—that first-mentioned person,

shall not be deemed to have complied with the demand under sub-

regulation (1) in respect of which the assurance was given.";

(g)

by omitting from sub-regulation (3) the words "of this regulation "; and

(h)

by omitting from sub-regulation (3) the words "exhibit or deliver the ticket issued to him for the journey for which he has paid or produce for inspection his daily or monthly ticket " and substituting the words " comply with that demand ".

6. Regulation 25 of the Motor Omnibus Services Regulations is amended by

omitting from sub-regulation (2) the words " the last preceding sub-regulation"

omitting sub-regulation (2) and substituting the following sub-regulations: — and substituting the word and figure " sub-regulation (1) ". 7. Regulation 31 of the Motor Omnibus Services Regulations is amended by " ( 2 ) Sub-regulation (1) does not apply to a blind person in respect of a

guide dog used for his guidance.

" (3) In sub-regulation (2) , ' guide dog ' has the same meaning as in the Dog

Control Ordinance 1975.".

8. Regulation 34 of the Motor Omnibus Services Regulations is amended by

omitting from sub-regulation (3) the words "of these Regulations".

9. Regulation 36 of the Motor Omnibus Services Regulations is amended—

(a)

by omitting from sub-regulation (1) the words "fifteen years" and substituting the figures and words " 1 5 years or any other person, being a school student,"; and

(b)

by omitting from sub-regulation (2) the words " fifteen years to whom the last preceding sub-regulation " and substituting the words " 1 5 years or any other person, being a school student, to whom sub-regulation (1) ".

10. Regulation 37 of the Motor Omnibus Services Regulations is amended by

omitting the words " Fifty dollars " and substituting the figures " $50 ".
