Amendments of the Milk Authority Regulations (ACT)

Regulations under the Milk Authority Ordinance 1971-1972.*

,	hereby m a k e the following Regulations under the Milk Authority	Ordinance

I 1971-1972.

A M E N D M E N T S O F T H E M I L K A U T H O R I T Y R E G U L A T I O N S !

1. After regulation 1 of the Milk Authori ty Regulations the following regu­

lation is inserted:—

" 1A. In these Regulations, unless the contrary intention appears , ' cream '

does not include sour cream.".

2. Regulation 5 of the Milk Authori ty Regulations is repealed and the

following regulation inserted in its s tead:—

" 5. The annual fee payable in respect of a wholesaler's licence i s—

(a) where the holder of the licence is the holder of not more than one such l icence—the sum of—

(i) Ten dollars; and

(ii)   an amount calculated at the rate of 0.15 cents per gallon of milk received into the premises specified in that licence by him in the course of the business to which the licence relates during the term of the licence last preceding the date on which the fee becomes payable; and

(b) where the holder of the licence is the holder of more than one such l icence—the sum of—

(i) Ten dollars; and

(ii)    an amount equal to an amount calculated at the rate of 0.15 cents per gallon of milk received into the premises specified in those licences by h im in the course of the business to which the licences relate during the respective terms of the licences last preceding the date on which the fee becomes payable divided by the number of those licences.".

3. Regulation 6 of the Milk Authori ty Regulations is amended by omitting the words " the rate of 0.25 cents per gallon of milk sold or delivered in the Terri tory by the holder of the licence " and inserting in their stead the words " the rate of 0.34 cents for every dollar of the amount payable by the holder of the licence for milk and cream supplied to him by the holders of wholesaler's licences for sale by him ".

4. Regulation 7 of the Milk Author i ty Regulations is amended by omit t ing all of the words from and including the words " the rate of 0.25 cents per gallon of milk " and inserting in their stead the words " the rate of 0.34 cents for every dollar of the amoun t payable by the holder of the permit for milk and cream supplied to h im by the holders of wholesaler 's licences for sale by him in the course of his business during the t e rm of the permit last preceding the date on which the fee becomes payable." .

5. Regulation 10 of the Milk Authori ty Regulations is amended by omitt ing
sub-regulation (3 . ) and inserting in its stead the following sub-regulat ions:—

" (3 . ) Subject to sub-regulation (5 . ) of this regulation, there is payable to the Cha i rman of the Authori ty for each day on which he is engaged, with the approval of the Authori ty , on business of the Author i ty—

(a) if the duration of the period during which he is so engaged on that

day is no t less than three hour s—a fee of For ty dollars; or

(b) if the duration of the period during which he is so engaged on that day is less than three hour s—a fee of Twenty-five dollars.

" (4 . ) Subject to the next succeeding sub-regulation, there is payable to a
member of the Authori ty other than the Cha i rman for each day on which he

is engaged, with the approval of the Authori ty , on business of the Author i ty—

(a) if the duration of the period during which he is so engaged on that

day is not less than three hou r s—a fee of Thirty-five dollars; o r

(b) if the duration of the period during which he is so engaged on that day is less than three hou r s—a fee of Twenty dollars .

" (5 . ) Where the Chai rman of the Authori ty or a member of the Author i ty—

(a)	at tends, on a day, a meeting of the Author i ty ; and
(b)	is also, on the same day, engaged for a period, with the approval of the Authori ty , on other business of the Authori ty ,

a fee is not payable to him in accordance with sub-regulation (3 . ) or sub- regulation (4 . ) of this regulation in respect of the period referred to in paragraph (b) of this sub-regulation but the fee payable to him in respect of that day in accordance with sub-regulation (1 . ) or sub-regulation (2 . ) of this regulation is the fee that would be payable to him' in respect of that day if, on that day, he had, in addition to at tending the meeting referred to in paragraph ( a ) of this sub-regulation, also attended a meet ing of the Authori ty during the period referred to in paragraph (b) of this sub-regulation.

" (6 . ) Where the Cha i rman of the Authori ty or a member of the Authori ty is necessarily absent overnight f rom his place of res idence—

(a ) in order to attend a meeting of the Authori ty; or

(b) in order to perform any business of the Authority on which he is engaged with the approval of the Authori ty ,

travelling al lowance in respect of the period of absence is payable to him at the
rate of Twenty-five dollars per day.

" (7 . ) Travelling allowance payable under the last preceding sub-regulation is in addition to, and does not include, the cost of conveyance." .

6. Regulation 12 of the Milk Authori ty Regulations is amended by omit t ing from sub-regulation (1.) the definition of " c ream ".
