Regulations under the Health Commission Ordinance 1975'

REGULATIONS 2
1. These Regulations shall come into operation on 1 September
1979.
2. Regulation 3 of the Health Commission (Charges) Regulations is
amended—
(a) by omitting from sub-regulation (1) "sub-section 74 ( 1 ) " and
substituting' ' sub-section 7 4 ( 2 ) " ; (b )
by omitting from paragraph (1) (a) " $ 6 0 " and substituting " $ 7 5 " ;
(c)
by omitting from paragraph (1) (b) "$40" and substituting " $ 5 0 " .
(d )
by omitting from paragraph (1) (c) " $ 4 0 " and substituting " $ 5 0 " ;
(e) by omitting from sub-regulation (2) "sub-section 74 ( 1 ) " and
substituting' ' sub-section 7 4 ( 2 ) " ; (f)
by omitting from sub-regulation (2) " $ 1 0 0 " and substituting " $ 1 3 6 " ;
(ii) "$20 " and substituting "$25 ". (g) by omitting sub-regulation (7); and
(h) by omitting from sub-regulation (10):(i) "sub-section 74 (1)" and substituting "sub-section 74
( 2 ) " ; and
3. Regulation 3A of the Health Commission (Charges) Regulations is amended—
(a ) by omitting from sub-regulation (1) "sub-section 74 ( 1 ) " and substituting "sub-section 74 ( 2 ) " ; and (b) by omitting from sub-regulation (2) "sub-section 74 ( 1 ) " and
substituting "sub-section 7 4 ( 2 ) " .
4. Regulation 4 of the Health Commission (Charges) Regulations is amended by omitting "sub-section 74 ( 1 ) " and substituting "sub section 74 ( 2 ) " .
5. Regulation 5 of the Health Commission (Charges) Regulations is
amended by omitting from sub-regulation (2) "sub-section 74 ( 1 ) " and

6. Regulation 5A of the Health Commission (Charges) Regulations is amended by omitting from sub-regulation (2) "sub-section 74 ( 1 ) " and substituting "sub-section 74 ( 2 ) " .
7. Regulation 6 of the Health Commission (Charges) Regulations is amended by omitting from sub-regulation (1) "sub-section 74 ( 1 ) " and substituting "sub-section 74 ( 2 ) " .
8. Regulation 6A of the Health Commission (Charges) Regulations
is amended by omitting from sub-regulation (1) "sub-section 74 ( 1 ) "

10. Regulation 7 of the Health Commission (Charges) Regulations is amended —
(a) by omitting from sub-regulation (1) "sub-section 74 ( 1 ) " and substituting "sub-section 74 ( 2 ) " ; and (b) by omitting from sub-regulation (2) "sub-section 74 ( 1 ) " and substituting "sub-section 74 ( 2 ) " .
11. Regulation 8 of the Health Commission (Charges) Regulations is amended by omitting "sub-section 74 ( 1 ) " and substituting "sub section 74 ( 2 ) " .
12. Regulation 9 of the Health Commission (Charges) Regulations
is repealed and the following regulation substituted:
" 9 . (1) In this regulation—
'dependant ' , in relation to a person included in a prescribed class of
persons, means—
(a) the wife of the first-mentioned person; (b) a w o m a n w h o i s living with the first-mentioned person as his wife on a permanent and bona fide basis, although not legally married to him; (c) a child under the age of 16 years who is in the custody, care and control of the first-mentioned person or of the wife or husband of that person; or (d) a person wholly or substantially dependent on the first- mentioned person or on the wife or husband of that per son, being a person who— (i) has attained the age of 16 years;
(ii) is receiving full-time education at a school, col lege or university; and
(iii) is not in receipt of an invalid pension under Part III of the Social Services Act 1947;
'infectious disease' means an infectious disease prescribed under the
Public Health (Infectious and Notifiable Diseases) Regulations;
'recognized hospital ' has the same meaning as in the Health In
surance Act 1973.
" ( 2 ) For the purposes of sub-section 74 (3) of the Ordinance, each of the following classes of persons is prescribed:
(a )
persons who are in receipt of an age pension, an invalid pension or a widow's pension under Part III of the Social Services Act 1974, or dependants of such persons;
(b )
persons who are suffering from an infectious disease; (c)
persons who are provided with an ambulance service in relation to the diagnosis, treatment or control of tuberculosis;
(d)
persons who have not attained the age of 18 years and for whom the need for an ambulance service occurred while in at tendance at a school or while travelling to or from a school;
(e)
persons who are financial members of the ambulance subscrip tion scheme conducted by the Commission, or dependants of such persons;
(f)
persons who are patients in a recognized hospital in the Terri tory and who are required to be moved from that hospital to another recognized hospital in the Territory; and
(g)
persons who are members of an ambulance subscription scheme conducted in a State or Territory with which there is in existence
an agreement with the Commission in relation to the provision
of ambulance services, or dependant of such persons.".
13. The Schedule to the Health Commission (Charges) Regulations is repealed and the following schedule substituted:

14. (1) The amendment effected by regulation 13 does not apply in relation to a dental service provided by the Commission where any act forming part of the provision of that service was done before the com mencement of these Regulations.
(2) The Health Commission (Charges) Regulations, as in force im mediately before the commencement of these Regulations, continue to apply in relation to a dental service provided by the Commission where any act forming part of the provision of that service was done before the commencement of these Regulations.
