Amendments of the Garbage Regulations (ACT)

Regulations under the Building and Services Ordinance
1924-1968.*
I, ANTHONY ALLAN STALEY, the Minister of State for the Capital Territory, hereby make the following Regulations under the Building and Services Ordinance 1924-1968.

AMENDMENTS OF THE GARBAGE REGULATIONS!
1. Regulation 3A of the Garbage Regulations is amended—•
(a) by omitting from sub-regulation (2) the figure "6" and substituting the figure " 9 "; and (b) by adding at the end thereof the following sub-regulation:—
" (7) A reference in this regulation to a removal of garbage from a receptacle includes a reference to an attempted removal where the receptacle is found to contain no garbage.".
2. After regulation 3A of the Garbage Regulations the following regulations are inserted:—
" 3 B . (1) A prescribed body may apply to an authorized officer to have
premises used by that body treated as premises other than commercial premises
for the purposes of these Regulations.
" (2) Where the authorized officer is satisfied that the body is a prescribed body, he may grant the application.
" (3) Where an application under this regulation has been granted in respect of premises, the premises shall, for the purposes of these Regulations, be deemed not to be commercial premises.

" ( 4 ) In sub-regulation (1) , 'prescribed body' means a body formed for
religious, educational, cultural, benevolent or other charitable purposes, not being
a body formed for the purpose of trading or of securing a profit for its members.
" 3c. (1) Notwithstanding any other provision of these Regulations, an occupier of premises may enter into arrangements with a person other than the Minister for the removal of part or all of the garbage from those premises.
" (2) Where an occupier has entered into an arrangement under sub-

the occupier shall ensure that the garbage is kept on the premises in a neat and tidy manner; and

all paper, cardboard and other garbage consisting of similar materials shall be bundled and tied.
" (3) Where an occupier complies with the requirements of sub-regulation (2) , the provisions of regulations 3, 4 and 5 do not apply to or in relation to the garbage in respect of which the arrangements have been entered into by the occupier.".
3. Regulation 9 of the Garbage Regulations is amended by omitting from sub- regulation (2) the words " and may make a charge of 10 cents for each additional receptacle at each such removal ".
4. The Garbage Regulations are amended by omitting Schedule 2 and substi tuting the following Schedule: —
" SCHEDULE 2 Regulation 3A
FEES FOR REMOVAL OF GARBAGE FROM COMMERCIAL PREMISES
1. Where garbage is removed from a domestic receptacle, a fee calculated at the rate of 17.5 cents for each receptacle.
2. Where garbage is removed from a commercial receptacle, a fee in respect of removal from a receptacle specified in column 1 of the following table equal to the aggregate of the weekly fee specified in column 2, and the removal fee specified in column 3, of the table opposite to the receptacle:—
