Regulations under the Fish Protection Ordinance

1929-1949.

Jfrotection Ordinance 1929-1949, hereby make the following Regulations.

A M E N D M E N T S O F T H E F I S H P R O T E C T I O N R E G U L A T I O N S .

1. Regulation 4 of the Fish Protection Regulations is amended by Licences,

omitting sub-regulation (1.) and inserting in its stead the following

sub-regulation:—

" (1.) A person shall not take fish in any waters unless he is the

holder of a licence in force authorizing him to do so.

Pena l ty :  Ten pounds.".

2. Regulation 6 of the Fish Protection Regulations is repealed and the following regulation inserted in its stead:—

" 6 . — (1.) W h e r e — Inspection of

(a) an Inspector finds a person fishing, or reasonably suspects

that a person has been fishing, in any waters; and

(b) the Inspector requires that person to state whether he is the

holder of a licence,

that person shall not fail or refuse to state whether he is the holder of a

licence.

" (2.) Where a person states that he is the holder of a licence and the Inspector requires that person to produce his licence, that person shall not, without reasonable excuse, fail or refuse to produce forthwith his licence to the Inspector.

" (3.) A person who, when required to produce his licence, satis- fies the Inspector that he has a reasonable excuse for not then producing his licence shall not fail to produce his licence to the Registrar at the Office of the Registrar at a time specified by the Inspector.

Pena l ty :  Two pounds.".

dose 3. Regulation 7 of the Fish Protection Regulations is amended—
seasons

(a) by omitting sub-regulation (1.) and inserting in its stead the

following sub-regulation:—

" (1.) A person shall not take trout (Salmo fario or Salmo irideus) from any waters during the period which commences on the first Monday in May and ends on the Friday preceding the first Monday in October (both days inclusive), in each year.";

(b) by omitting sub-regulation (2A.) ; and

(c) by omitting sub-regulation (3.) and inserting in its stead

the following sub-regulation:— ^0

" (3.) A person shall not at any time, take fish frorn\

waters other than— 4

(a) the waters of—

(i) that portion of the Cotter River that lies

below the weir; and

(ii)   that portion of that River that lies above the junction of that River with Pierce's Creek;

(b) the waters of the Gudgenby River;
(c) the. waters of the Molonglo River;
(d) the waters of the Murrumbidgee River;
(e) the waters of the Naas River; and
(/) the waters of Paddy's River.".

Licences issued 4. Notwithstanding anything contained in a licence under the Fish commencement Protection Regulations issued before the commencement of these Regu-

(a) shall not authorize the holder of the licence to take fish otherwise than in accordance with the Fish Protection Regulations as amended by these Regulations; and

(b) shall, unless sooner cancelled or suspended, be deemed j | £ authorize the taking of trout {Salmo fario or Sal*ro^ irideus) until the third day of May, 1953.
