Regulations under the Education Ordinance 1937-1942.*

Education Ordinance 1937-1942, hereby make the following Regulations.

A M E N D M E N T S O F T H E E D U C A T I O N R E G U L A T I O N S .

1. Regulation 4 of the Education Regulations is amended by insert- Deflnitio

ing after the definition of " public school " the following definition :—

" 'qua l i fy ing examination ' means the qualifying examination

for candidates for bursaries conducted by the Department

of Education of the State of New South Wales;".

omitting from paragraph (6) of sub-regulation (1.) all the words school'0'' 2. Regulation 18 of the Education Regulations is amended by Circumstances

For the purposes of this paragraph, the word ' dependant ' includes any relative of a parent or the guardian ordinarily residing with, and wholly maintained by, him or her, as the case may be, but does not include any child or relative earning fifteen shillings oi' more, per week, or any invalid in respect of whom any deduction has been made from the income in accordance with the provisions of this paragraph.".

Candidates 3. Regulation 27 of the Education Regulations is amended—

For the purposes of this sub-regulation, the word ' dependant ' includes any relative of a parent or the guardian ordinarily residing with, and wholly maintained by him or her, as the case may be, but does not include any child or relative earning fifteen shillings or more, per week, or any invalid in respect of whom any deduc- tion has been made from the income in accordance with the provisions of this sub-regulation."; and

(/;) by inserting after sub-regulation (J . ) the following sub-

regulations :—
" ( 1 A . ) A bursary shall not be granted to any child unless an undertaking, in writing, is given to the Minis- ter by a parent or the guardian that the child shall be kept at school until the completion of the course for which the child is enrolled.

" ( 1 B . ) Notwithstanding anything contained in these Regulations, the Minister may—

(a) determine, as he deems fit, by notice in the mum amount prescribed by sub-regulation (1.) of this regulation shall be increased where the number of dependants exceeds ten; and Gazette, by what amount, if any, the maxi-

(b) authorize, where special circumstances appear to him to justify it, the continuation of any bursary where the income of the parents or guardian of the holder exceeds the appropriate amount prescribed or as determined under this sub-regulation.".

Limit of age.

4. Regulation 30 of the Education Regulations is amended by omitting the words " the date fixed for the qualifying examination for bursar ies" and inserting in their stead the words " t h e first day of J anua ry following the date fixed for holding the qualifying examination ".

5. Regulation 45 of the Education Regulations is amended by omit- Power of ting paragraph (b) and inserting in its stead the following para-remit fees. graph:—

" (b) either wholly or in part, remit the payment of any such

fee or refund the amount of any fee pa id ; and ".

6. The First Schedule to the Education Regulations is amended— First-m*;;

(a) by omitting from Form 13 the words " following the Examina t ion" and inserting in their stead the words " following the date fixed for holding the qualifying examination " ;

(b) by inserting in that Form, after the words " This applica- tion ", the words ", accompanied by a Statutory Declara- tion made by the applicant in accordance with Form 14,"; and

(c) by omitting from that Form the words " Bursary and High School examinat ion" and inserting in their stead the words " qualifying examination ".
