T H E R B E R T VICTOR J O H N S O N , the Minister of State for the A , Interior, in pursuance of the powers conferred upon me by the Education Ordinance 1937-1042, hereby make flu following Regulation-.

3. Regulation 19 of the Education Regulations is repealed and the

following regulation inserted in its stead:—

" 1 9 . The rate of the grant in aid of conveyance payable under Kate nf grant this Pa r t for each complete day of attendance at school of a child ,""eyanre. shall be—

(a) in the case of a child conveyed not more than five miles—

sixpence;

(1>) in the case of a child conveyed more than five miles bur

not more than ten miles—ninepence;

(c) in the case of a child conveyed more than ten miles but not

more than fifteen miles—twelve pence;

(d) in the case of a child conveyed more than fifteen miles—

fifteen pence; and

(e) in any ca.se where special circumstances exist—such rat"

as the Minister approves.".

5. After Division 3 of Far t IV. of tbe-e Regulations, the following

Division is inserted :—

"Division 4.—Nursery Kindergarten Teacher Scholarships.

Nursery

Kindergarten " 43A.—(1 . ) Subject to these Regulations, the Minister may award
Teacher such number as he annually determines of Nursery Kindergarten

Sciiolarshics.

Teacher Scholarships, tenable at a Kindergarten Training College approved by the Minister, to persons desirous of pursuing a course of training as Nursery Kindergarten Teachers.

" (2.) Any such scholarship shall be tenable for one year and may be renewed for two further successive periods of one year if the Minister is satisfied, on reports received from the Principal of the Training College, with the diligence, conduct, efficiency and aptitude of the trainee, at the end of the first and the second year respectively. " (3.) The amount of each such scholarship shall be—

(a) in re=pect of the first two years—One hundred and twenty

pounds for each year ; and

(b) in respect of the third year—such amount a.s the Minister

determines,

"*' (4.) The award of any scholarship under this regulation shall be subject to the prospective student and one surety entering into a bond in accordance with the form in the Third Schedule.

6. After the Second Schedule to the Education Regulations the

following Schedule is added :—

10 ALL TO WHOM THESE PRESENTS SHALL COME, WE,

in the -aid Territory, (hereinafter referred to us

WHKKKAS the Minister of State for the Interior (hereinafter referred to as "the Minister ' ) invited applieations for scholarships to be awarded to selected persons desirous of pursuing an approved course of training as Nursery Kindergarten teachers for service in the said Territory:

AND WHKKKAS the student made application for one of the said scholar- ships and was duly selected by the Minister:

AN]) WHKKKAS the said scholarship may be held at an approved Kinder- garten Training College for a period of three years but is subject to renewal at the end of the first and second years respectively, subject to satisfactory reports being received from the I'rinriiial of the Training College in regard to conduct efficiency and suitability of the student:

AND WHKKKAS the value of each scholarship shall be One bundled and twenty pounds (£120) for the first year. One hundred and twenty pounds (£120) for the second year and an amount to be determined by the Minister for the third year, eaeli of such amounts being payable by the Minister in equal instal- ments at the commencement of each term:

Kindergarten Training College .situated at

AXD WHKKKAS the Minister has approved of the Kindergarten

Training College as an institution at which the scholarship may be held and has approved of the course of training provided by such College:

NOW KNOW VK THAT—

1. In consideration of the premises the Student for herself her executors

j;nd administrators covenants with the Commonwealth of Australia: —

(a) That she will pursue her studies in the said course to the satisfaction

of the Minister :

(b) That she will not relinquish the said course without the consent in writing of the Minister: Provided that the Minister may in his unfettered discretion give or refuse such consent without assigning am reason for his decision and may if he thinks fit before giving such consent require the Student to comply with such conditions (whether as to the repayment of the expense incurred by the Minister by reason of the grant of the benefit or otherwise) as the Minister may impose: and
(c) That she will, if required by the Minister, or by the Director of Education of the State of New South Wales upon completion of the said course of training accept an appointment as a Nursery Kinder- garten teacher in the Australian Capital Territory at a pre-school

i Commonwealth Public Service Act and Regulations in respect to centre or a nursery school under conditions prescribed by the
temporary employment or the Public Service Act and Regulations administered by the New South Wales Department of Kducation, as the car-e may lie, and that she will remain and continue in such employment until the expiration of a period of three years after such appointment, with remuneration according to the scale adopted by the Department of Kducation of New South Wales for the grade of work performed.

2. In consideration of the grant to the Student of the scholarship aforesaid the Student and the Surety for themselves and their and each of tlieir executors and. administrators jointly and severally covenant with the Commonwealth of Australia that in the event of the failure of the Student duly to complete the said course and such failure being in the opinion of the Minister due to causes within the control of the Student or in the event of any breach or non-observance by the Student of any covenant on her part to be observed and performed they will forthwith on demand by the Minister pay to the Minister such sum as shall be assessed by him as equivalent to the amount of the monies paid by the Minister to the Student in respect of the scholarship: Provided that the liability of the Student and/or Surety or their executors or administrators shall in no ease exceed the stun of Two hundred and eighty pounds (£280).

•';. It is hereby agreed and declared that a Certificate by the Minister stating the .siim to be paid by the Student and the Surety under clause 2 hereof shall lie conclusive evidence of the matter stated.

4. If on the application of the Student and with the consent of the Minister the grant of the .scholarship aforesaid to the Student is suspended for any period it is hereby covenanted by the Student and the Surety with the Common- wealth of Australia that the liability of the Student and the Surety under clause 2 hereof shall not by reason of such suspension be avoided lessened weakened or discharged or in any way impaired and no consent of the Surety to such suspension shall be necessary or required for the continuance of the said liability.

5. Any approval consent requirement demand or other communication to lie given by the Minister shall be deemed to have been duly given if signed by or on behalf of the Secretary Department of the Interior and handed to the Student or ]msted to the Student at her usual or last-named place of address and any certificate signed as aforesaid stating any opinion of the Minister on any matter on which he is to give an opinion under these presents or whether anything has or lias not been done to his satisfaction shall be conclusive evidence of the matter stated.
