Regulations under the Building and Services Ordinance

1924-1942.*

AMENDMENTS OF THE CANBERRA BUILDING REGULATIONS.!

1. These Regulations shall come into operation on the first day of Commence- ment-
October, 1959.

2. Regulation 4 of the Canberra Building Regulations is amended by Ddinitions.

omitting from sub-regulation (1.) the definition of "Archi tect" .

4. Regulation 7 of the Canberra Building Regulations is repealed and the following regulation inserted in its stead:—

"7 .—(1. ) A person may make application in accordance with this Builders'

' " (2.) An application for a Builder's Licence shall be in accordance

with Form D and shall be accompanied by—

(a) the prescribed fee;

(b) a certificate in accordance with Form DA, signed by three

householders;

(c) certificates as to the ability of the applicant as a builder from two architects registered or qualified to be registered under the Architects Ordinance 1959; and

(d) a letter from a banker indicating that the applicant's financial

position is satisfactory.

" (3.) An application for a Builder's Special Licence shall be in accordance with form DD and shall be accompanied by the prescribed fee and such of the documents specified in paragraphs (b), (c) and (rf) of the last preceding sub-regulation as are required by the proper authority. " (4.) The proper authority may require an applicant under this

regulation to produce such further evidence of the applicant's qualifica-
tions and character as the proper authority considers necessary.

" (5.) The proper authority may, in his discretion, issue to an applicant under this regulation a Builder's Licence or a Builder's Special Licence, as the case requires.

" (6.) A Builder's Licence expires on the thirty-first day of December next following the date of commencement of the licence, or of the las; renewal of the licence, as the case may be, but may be renewed b the proper authority from time to time upon receipt before, or not later than one month after, the date of expiry of the licence, of an application in writing accompanied by the prescribed fee for the renewal.

" (7.) A Builder's Special Licence to carry on the business of a building contractor for a specified period may be renewed, until a specified date, by the proper authority from time to time upon receipt before, or not later than seven days after, the date of expiry of the licence, of an application in writing accompanied by the prescribed fee for the renewal.

" (8.) Where a Builder's Licence or a Builder's Special Licence is renewed in accordance with this regulation, the renewal commences, or shall be deemed to have commenced, on the day after the date of expiry of the licence.

" (9.) The proper authority may, by notice in writing to the holder, cancel or suspend a Builder's Licence or a Builder's Special Licence.

" (10.) A person whose Builder's Licence or Builder's Special Licence is cancelled or suspended shall be deemed not to be the holder of a Builder's Licence or a Builder's Special Licence, as the case may be, and shall on demand in writing by the proper authority return his licence to the proper authority.
" (11.) A Builder's Licence shall be in accordance with Form E and a Builder's Special Licence shall be in accordance with Form EE.".

(a) by omitting the words—

" *My qualifications to carry on the business of Building

Contractor are as follows:—

I enclose certificate in accordance with Form B in the Schedule to

the above-mentioned Regulations."

and inserting in their stead the words—

" My qualifications to carry on the business of a Building Contractor

are as follows:—

I enclose a certificate in accordance with Form DA in the Schedule to the above-mentioned Regulations, certificates as to my ability as a builder from two architects registered or qualified to be registered under the Architects Ordinance 1959 and a letter from a banker indicating

that roy financial position is satisfactory."; and

(b) by omitting the word " * N O T E " and all the.words following

that word.

9. The Schedule to the Canberra Building Regulations is amended by Form DA.

1 inserting after Form D the following form:—

10. Form DD in the Schedule to the Canberra Building Regulations is Form DD.

amended—

(a) by omitting the words " I enclose certificate in accordance

with Form B in the Schedule to the above-mentioned

that word.
