Amendments of the Building Regulations (ACT)

Regulations under the Building Ordinance 1972-1974.*

I, GORDON MUNRO BRYANT, the Minister of State for the Capital Territory, hereby make the following Regulations under the Building Ordinance 1972-1974.

AMENDMENTS OF THE BUILDING REGULATIONS!

1. Regulation 6 of the Building Regulations is repealed and the following regulation substituted:—

" 6 . (1) Subject to sub-regulation (3) , the prescribed fee payable on an application for approval of plans and specifications relating to residential building work is—

(a)	where the plans and specifications provide for the erection of a building—the fee calculated in accordance with Part I of Schedule 2; or
(b)	where the plans and specifications provide for the demolition of a building, the alteration of or addition to a building or the erection or construction of a fence, retaining wall, swimming pool, ornamental pond, mast, antenna, aerial, advertising device, notice or sign— 0.5% of the cost of the demolition, alteration, addition, erection or construction.

" (2) Subject to sub-regulation (3) , the prescribed fee payable on an appli­ cation for approval of plans and specifications relating to commercial building work is the fee calculated in accordance with Part II of Schedule 2.

" (3) Notwithstanding the provisions of sub-regulations (1) and (2) , the minimum fee payable in respect of an application for approval of plans and speci­ fications is $10.".

2 . Regulations 9 and 10 of the Building Regulations are repealed and the following regulation substituted:—

" 9 . (1) Subject to sub-regulation (3) , the prescribed fee payable for a building permit in respect of residential building work is—•

(a) in the case of a permit for the erection of a building—the fee cal­ culated in accordance with Part I of Schedule 2; or

• Notified in the Australian Government Gazette on 27 February 1975.

(b) in the case of a permit for the demolition of a building, the alteration of or addition to a building or the erection or construction of a fence, retaining wall, swimming pool, ornamental pond, mast, antenna, aerial, advertising device, notice or sign—0.5% of the cost of the demolition, alteration, addition, erection or construction.

" (2) Subject to sub-regulation (3) , the prescribed fee payable for a building permit in respect of commercial building work is the fee calculated in accordance with Part II of Schedule 2.

" (3) Notwithstanding the provisions of sub-regulations (1) and (2) , the

minimum fee payable for a building permit is—

(a) in the case of a permit referred to in sub-regulation (1)—$10; and

(b) in the case of a permit referred to in sub-regulation (2)—$20.".

3 . Regulation 11 of the Building Regulations is amended by omitting the

words " Five dollars " and substituting the symbol and figures " $10 ".

4. Regulation 12 of the Building Regulations is amended—

(a)	by omitting from sub-regulation (1) the words "Five dollars" and substituting the symbol and figures " $10 ";
(b)	by omitting from the formula in sub-regulation (2) the figure " 5 " and substituting the figures " 1 0 ".

5. Regulation 15 of the Building Regulations is amended—

(a)	by omitting the words " Five dollars " and substituting the symbol and figures " $10 "; and
(b)	by omitting the words " Two dollars " and substituting the symbol and figure " $4 ".

6. Regulation 16 of the Building Regulations is amended by omitting from

sub-regulation (2) the words " Four dollars" and substituting the symbol and

figure " $5 ".

7 . Regulation 17 of the Building Regulations is amended by omitting from

sub-regulation (2) the words " One dollar" and substituting the symbol and

regulation (1) and substituting the following sub-regulation:— figure " $5 ". 8. Regulation 18 of the Building Regulations is amended by omititng sub- " (1) Subject to sub-regulation (2) , the prescribed fee for a photocopy made

by the Building Controller of a document in his records is as follows:—

For plans and drawings—per 0.1m 2 or part of 0.1m 2 . . . . . . . . 2.00

For specifications—per foolscap sheet or part of a foolscap sheet	. .	0.50
For other documents—per sheet . .	. .	0.50

9. The Building Regulations are amended—•

(a) by omitting from The Schedule the words " THE SCHEDULE " and substituting the words—

(b) by adding at the end thereof the following Schedule:—
