Regulations under the Building Ordinance 1972*

I, WILLIAM MICHAEL HODGMAN, the Minister of State for the Capital Territory, hereby make the following Regulations under the Building Ordinance 1972.

AMENDMENTS OF THE BUILDING REGULATIONS!

1. Regulation 2 of the Building Regulations is amended—

(a)

by omitting from the definition of " cost" in sub-regulation (1) " but does not include the cost of the land on which the building work is to be carried out;" and substituting " and includes the cost of any engineering service proposed to be constructed, installed or carried out on or in relation to the land on which the building work is to be carried out but does not include the cost of that land;";

(b)

by inserting after the definition of " cost" in that sub- regulation the following definition:

t Regulations 1972 No . 8 as amended by 1974 No. 5; 1975 No . 3 ; 1978 No. 2; and 1979 Nos. 18 and 26.

" ' engineering service ', in relation to land on which building work is to be carried out, includes any electrical service, the construction or installation of a driveway, kerb, guttering or storm-water drain­ age, or the carrying out of regrading or contouring, on or in relation to that land;"; and

(c)

by omitting from the definition of " residential building work " in that sub-regulation " of units within the meaning of the Unit Titles Ordinance 1970 or ".

2. Regulation 6 of the Building Regulations is amended—

(a)

by omitting paragraph (1) (a) and substituting the follow­ " (a) where the plans provide for the erection of a build­

ing, other than a building referred to in paragraph (1) ( a a )—0.25% of the cost of the erection;"; and

(b) by omitting from sub-regulation (2) " Part II of ".

3. Regulation 9 of the Building Regulations is amended—

(a)

by omitting paragraph (1) (a) and substituting the follow­ " (a) in the case of a permit for the erection of a building,

other than a building referred to in paragraph (1) ( b ) — 0 . 2 5 % of the cost of the erection;"; and

(b) by omitting from sub-regulation (3) " Part II of".

4. Regulation 17 of the Building Regulations is amended by insert­ ing in sub-regulation (2) ", or by the proprietor of a unit within the meaning of the Unit Titles Ordinance 1970," after " owner of a parcel of land ".

5. Regulation 18 of the Building Regulations is repealed and the following regulation substituted:

" 1 8 . (1) Subject to sub-regulation (5 ) , the prescribed fee for a photocopy made by the Building Controller of a document in records kept by him is as follows:

" (2) Subject to sub-regulation (5 ) , the prescribed fee for a cer­ tified copy of a document in records kept by the Building Controller is $5 per sheet.

" (3) Subject to sub-regulation (4 ) , the prescribed fee for retrieving from the records kept by the Building Controller a file for the purpose of photocopying a document or documents on that file is $2.

" (4) The prescribed fee referred to in sub-regulation (3) is not payable by a person who has paid a prescribed search fee under regulation 17 and who, during the course of, or immediately after the search, requests a photocopy of a document located in the records kept by the Building Controller during the course of that search.

" (5) Copies of plans submitted in accordance with the Ordinance

shall not be furnished except in accordance with the instructions of—

(a)

the lessee or the owner of the parcel of land on which the building to which the plans relate is erected; or

(b)

where the plans relate to a unit within the meaning of the Unit Titles Ordinance 1970—the proprietor of the unit.".

6. Schedule 2 to the Building Regulations is repealed and the

following Schedule substituted:
