Amendments Incorporation Act

An Act for incorporating amendments in amended Acts and Regulations

1Short title

This Act may be cited as the Amendments Incorporation Act.

2Repeal

The Amendments Incorporation Ordinance 1922 is repealed.

2AInterpretation

In this Act, unless the contrary intention appears:

Act includes a State Act.

regulations includes rules and by-laws.

State Act means an Act of the State of South Australia continuing in force in the Territory as a law of the Territory.

3Incorporation of amendments in reprint of Act or regulations

• (1)

  When any Act has, or any regulations made under any Act have, before or after the commencement of this Act, been amended by:

  • (a)

    the repeal or omission of certain words or figures;

  • (b)

    the substitution of certain words or figures in lieu of any repealed or omitted words or figures; or

  • (c)

    the insertion of certain words or figures,

  then, in any reprint of the Act or regulations by the Government Printer, the Act or the regulations, as the case may be, shall be printed as so amended.

• (2)

  In every reprint of an Act or regulations so amended, reference shall be made in the margin or in a footnote to the Act or regulations by which each amendment is made.

• (3)

  In this section, words includes Part, Division, heading, section, subsection, regulation, subregulation, paragraph, subparagraph and Schedule.

4Citation in amended reprints of Acts

• (1)

  Where an Act has been amended, the provision of that Act relating to the citation of that Act shall be deemed to have been amended by substituting for the citation provided for in that Act the citation provided for by section 49(1)(c) of the Interpretation Act and, in a reprint of that first-mentioned Act as amended, prepared after the commencement of the Amendments Incorporation Act 1978, that citation shall be substituted accordingly.

• (2)

  Where a State Act has been amended, the provision of that Act relating to the citation of that Act shall be deemed to have been amended by substituting for that citation provided for in that Act the citation provided for by section 51(2) of the Interpretation Act and, in a reprint of that first-mentioned State Act as amended, prepared after the commencement of the Amendments Incorporation Ordinance 1978, that citation shall be substituted accordingly.

5Reference to amending Act or regulation

There shall be printed on every reprint issued by the Government Printer of any Act or of regulations made under any Act, a short reference to every Act or regulation (if any), as the case may be, by which the Act or the regulations have been amended.

6Omission of enacting words in reprint

In any reprint by the Government Printer of an Act or regulations, the Act or regulations may be printed without the inclusion of:

• (a)

  the words enacting the Act or regulations;

• (b)

  the date of the making of the Act or regulations;

• (c)

  the signature of the person making the Act or regulations; and

• (d)

  the signature of the person authenticating the signature of the person making the Act.
