Amendment Statement of Principles

concerning

LUMBAR SPONDYLOSIS

No. 68 of 2018

for the purposes of the

Veterans' Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

1. This Instrument may be cited as Amendment Statement of Principles concerning lumbar spondylosis No. 68 of 2018.

1. The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans' Entitlements Act 1986, Statement of Principles concerning lumbar spondylosis Instrument No. 63 of 2014 (Federal Register of Legislation No. F2014L00930) by:

A.Repealing factors "(i)", "(j)", "(x)" and "(y)" in clause 6 and substituting the following:

"(i)       liftingloads of at least 20 kilograms while bearing weight through the lumbar spine:

(i)to a cumulative total of at least 150 000 kilograms within any ten year period before the clinical onset of lumbar spondylosis; and

(ii)where the clinical onset of lumbar spondylosis occurs within the 25 years following that period; or";

"(j)       carrying loads of at least 20 kilograms while bearing weight through the lumbar spine:

(i)to a cumulative total of at least 3 800 hours within any ten year period before the clinical onset of lumbar spondylosis; and

(ii)where the clinical onset of lumbar spondylosis occurs within the 25 years following that period; or";

"(x)      liftingloads of at least 20 kilograms while bearing weight through the lumbar spine:

(i)to a cumulative total of at least 150 000 kilograms within any ten year period before the clinical worsening of lumbar spondylosis; and

(ii)where the clinical worsening of lumbar spondylosis occurs within the 25 years following that period; or";

"(y)      carrying loads of at least 20 kilograms while bearing weight through the lumbar spine:

(i)to a cumulative total of at least 3 800 hours within any ten year period before the clinical worsening of lumbar spondylosis; and

(ii)where the clinical worsening of lumbar spondylosis occurs within the 25 years following that period; or".

1. The amendments made by this instrument commence on 23 July 2018.
