Amendment Statement of Principles

concerning

AORTIC ANEURYSM

No. 72 of 2019

for the purposes of the

Veterans' Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

  1. This Instrument may be cited as Amendment Statement of Principles concerning aortic aneurysm No. 72 of 2019.

  1. The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans' Entitlements Act 1986, Statement of Principles concerning aortic aneurysm Instrument No. 10 of 2012 (Federal Register of Legislation No. F2012L00015) by:

(A)Inserting new factors "(ab)", "(ac)", "(na)" and "(nb)" in clause 6 as follows:

"(ab)    where exposure to second-hand smoke has not ceased, being exposed to second-hand smoke for at least 1 000 hours before the clinical onset of aortic aneurysm; or";

"(ac)    where exposure to second-hand smoke has ceased:

(i)    being exposed to second-hand smoke for at least 1 000 hours, but less than 5 000 hours, before the clinical onset of aortic aneurysm, and the clinical onset of aortic aneurysm has occurred within five years of the last exposure to second-hand smoke; or

(ii) being exposed to second-hand smoke for at least 5 000 hours before the clinical onset of aortic aneurysm; or";

"(na)    where exposure to second-hand smoke has not ceased, being exposed to second-hand smoke for at least 1 000 hours before the clinical worsening of aortic aneurysm; or";

"(nb)    where exposure to second-hand smoke has ceased:

(i)    being exposed to second-hand smoke for at least 1 000 hours, but less than 5 000 hours, before the clinical worsening of aortic aneurysm, and the clinical worsening of aortic aneurysm has occurred within five years of the last exposure to second-hand smoke; or

(ii) being exposed to second-hand smoke for at least 5 000 hours before the clinical worsening of aortic aneurysm; or"; and

(B)Inserting the following definition of "being exposed to second-hand smoke" in clause 9 in alphabetical order:

'"being exposed to second-hand smoke" means being in an enclosed space and inhaling smoke from burning tobacco products or smoke that has been exhaled by a person who is smoking;'.

  1. The amendments made by this instrument commence on 22 July 2019.
