Regulations under the Motor Traffic Ordinance

I , in pursuance of the powers conferred upon me by the Motor Traffic

rdinance 1936-1942, hereby make the following Regulations.

A M E N D M E N T OF T H E MOTOR T R A F F I C R E G U L A T I O N S .

1. Regulation 5 of the Motor Traffic Regulations is amended by Definitions,

omitting the definition of " the Ordinance " and inserting in its stead

the following definition:—

" ' the Ordinance ' means the Motor Traffic Ordinance 1936-1942,

as amended from time to t ime; ".

2. Regulation 9 of the Motor Traffic Regulations is amended— Registration
° ° of trailers.

{a) by omitting sub-regulation (2.) and inserting in its stead

the following sub-regulation :—

" (2.) I n the event of the Registrar registering the
trailer, hp shall grant to the applicant an owner's certifi-

cate in accordance with Form A in the First Schedule.";

(b) by adding at the end thereof the following sub-regulation:—
" (5.) A certificate of registration of a trailer shall

be in accordance with Form B in the First Schedule.".

3. After regulation 11 of the Motor Traffic Regulations the following

regulations are inserted :—
" 1 1 A . — ( 1 . ) Where a registered trailer is sold or disposed of, the Saieor former owner shall, within seven days after the sale or disposal, return trailers. to the Registrar the owners' certificate and the certificate of registration

of the trailer, each certificate being signed by him in the place for the signature of the former owner in the form for memoranda of transfers of registration, and shall furnish the registrar with—

(a) the full name and address of the new owner; and
(b) where the former owner was not the true owner of the

trailer, the written authority of the true owner or his duly authorized agent for the sale or disposal of the trailer.

" (2.) The purchaser or the person to whom the trailer was disposed of, shall, within seven days after the purchase or disposal, apply to the Registrar to have the registration of the trailer transferred to him.

" (3.) If the Registrar approves of the transfer he shall, on pay- ment by the applicant to the Commonwealth of a fee of Two shillings and sixpence, sign the owner's certificate and the certificate of registra- tion of the trailer in the space set apart therefor and return the certificate to the applicant who shall then be deemed to be the owner of the trailer for the purposes of the Ordinance.

Brakes on

" 11B.—(1.) Every trailer whose weight (inclusive of the load it is carrying) exceeds two tons, shall be equipped with at least one brake or combination of brakes of reasonable efficiency, having regard to the size of the trailer and load carried, and capable of being readily applied and retained either by the driver of the towing vehicle or by some person who is carried on or walking alongside the trailer within reach of the brake lever.

" (2.) Every trailer whose weight (inclusive of the load it is carrying) is less than two tons but exceeds five hundredweights shall be equipped with at least one brake capable of being readily applied either by the driver of the towing vehicle or automatically by the over-run of the trailer.

" (3.) It shall not be necessary for a trailer whose weight (inclusive of the load it is carrying) is less than five hundredweights to be equipped with brakes when coupled to a motor vehicle which, if retarded by its foot-brake, can be brought to rest from a speed of thirty miles per hour in less than fifty feet.".

places. 4. Regulation 12 of the Motor Traffic Regulations is amended by
inserting, after the word " streets ", the words " and the other areas ".

of standing 5. Regulation 13 of the Motor Traffic Regulations is amended—
or parking
in certain (a) by omitting from paragraph (h) of sub-regulation (1.) the
places. word " or " ;

(b) by adding at the end of that sub-regulation the following

paragraph:—

" ; or (;') within fifty yards of the official traffic sign in close proximity to the swimming pool at the junction of the Cotter River and Paddy's River; " ; and

(c) by inserting, after paragraph (c) of sub-regulation (4.), the

following paragraph:—

" ; or (d) that portion of the road, leading from the bridge over the Cotter River to the Cotter River Reservoir, which is between that bridge and the reservoir,".

6. Regu la t ion 14 of the Motor Traffic Regula t ions is amended— Motor lorry
(a) by omitting the words " vehicle licensed to ply for hire for ^public"" the carriage of goods " and inserting in their stead the 8treet-
word " lorry " ;
(b) by omitt ing the words " m o t o r veh ic le" (second occurring)

and inserting in their stead the word " lorry " ;

(c) by omitting the words " public stand " and inserting in their stead the words " any public street referred to in the last preceding regulation "; and

(d) by inserting in paragraph (c), after the word "hired", the words " if the lorry is a lorry licensed to ply for hire for the carriage of goods ".

' 7. Regulation 15 of the Motor Traffic Regulations is amended by Position

parking area at the Cotter River Reserve shall park the vehicle at r ight angles to the fence on the boundary of the parking area, or as directed by a member of the Police Force or an officer appointed by the Minister to direct traffic at the Cotter River Reserve.".

8. Regulation 16 of the Motor Traffic Regulations is amended by Overtaking

omitt ing sub-regulation (2.) and inserting in its stead the following traffic on

sub-regulation:— br id8M- *c-

" (2.) The driver of a motor vehicle upon Scott 's Crossing, Parkes , shall not at tempt to pass or overtake any traffic while such traffic is upon the low-level bridge at the crossing or upon the approach to tha t bridge.".

9. Regulation 32 of the Motor Traffic Regulations is repealed and Additions

the following regulations inserted in its stead :— Schedule—

column of the Table hereunder opposite an item in the first column of fnspection

This Certificate is granted subject to the Motor Traffic Ordinance 1930-1942, and any amendments thereof and the Regulations for the time being in force thereunder. The certificate is, in all proceedings under the Ordinance, prima facie evidence that the person last specified thereon as owner or new owner, as the case may be, of the trailer is the owner thereof. The certificate must be returned to the Registrar of Motor Vehicles within seven days after the date of the sale or disposal of the trailer or of any alteration thereof or in the event of its destruction or breaking up or of the owner changing his address.

their stead the following headings and paragraphs:—

" That portion of Giles-street 20 feet wide between Tench- street and a line 20 feet south-westerly from Jardine-street and within lines 10 feet from the north-western boundary of Giles- street and 5 feet from the alignment of the north-western kerb thereof.
