Regulation under the Apprenticeship Ordinance 1936-1974.*

I, LANCE HERBERT BARNARD, the Acting Minister of State for Education, hereby make the following Regulation under the Apprenticeship Ordinance 1936-1974.

AMENDMENT OF THE APPRENTICESHIP REGULATIONSt

Regulations 2 to 13 (inclusive) of, and the Schedule to, the Apprenticeship Regulations are repealed and the following regulations and Schedule sub­ stituted:—

" 2. In these Regulations, unless the contrary intention appears, ' the

Ordinance ' means the Apprenticeship Ordinance 1936-1974.

" 3. The rate at which allowance is payable under section 22 of the Ordin­

ance is Fifteen dollars per week.

" 4. Indentures of apprenticeship shall be in accordance with the Form set

out in the Schedule.

INDENTURE OF APPRENTICESHIP

THIS INDENTURE made the day of 19
between who was born on (hereinafter called
the apprentice) of the first part, of (hereinafter
called the employer) of the second part and of

parent or guardian of the apprentice (hereinafter called the guardian) of the third part

Witnesses as follows:—

1. The apprentice of his own free will and with the consent of the guardian hereby binds

himself apprentice to the employer to learn the trade of for a
term of years months, to be calculated from and be deemed
to have commenced on the day of 19

2. The apprentice and the guardian as surety for the apprentice jointly and severally bind

themselves for the true performance of all of the covenants and agreements set out above

and in the Schedule to this indenture.

1. The employer covenants with the apprentice and guardian and with each of them separately to teach and instruct the apprentice or cause the apprentice to be taught and instructed in the aforesaid trade by the best means in the employer's power during the said term and to provide facilities for the practical training of the apprentice and to give the apprentice every opportunity to learn the trade and to receive during the period of his apprenticeship such technical, trade, or other training as may be prescribed by any regula­ tions governing the employment of the apprentice and to observe faithfully all other agree­ ments and covenants set out herein.

2. This indenture shall be read subject to and so as to require compliance by the parties hereto with the provisions of the Apprenticeship Ordinance 1936-1974 and the Regulations made thereunder and with any award, order, agreement, or determination made pursuant to the Conciliation and Arbitration Act 1904-1973, affecting these presents and applicable to the apprentice.

3. The apprentice and the guardian as surety for the apprentice jointly and severally covenant with the employer—

(a)

That the apprentice will during the whole of the said term excepting such days on which he is entitled by law to be absent from his employment or days on which his absence is permitted by the employer diligently and faithfully serve the employer as his apprentice and at all times obey the lawful commands of the employer o r his representatives and will not absent himself from the employer's service during working hours without his consent.

(b)

That at all times the apprentice will not commit or permit to be accessary to any waste, damage, or other injury to the property or goods or business of the employer and will in the course of his employment with the employer conduct

himself in a courteous obedient and proper manner.

(c) That the apprentice shall, if so required by the Apprenticeship Board—

(i)    if absent from his work with the consent of the employer for more than fourteen days in one year; or

(ii)   if absent from his work for any period during one year without the consent of the employer,

serve, at the end of that year, one day for each day during which he was so absent, and the period of the next succeeding year of his apprenticeship shall be deemed not to begin until the additional day or days has or have been served.

(d) That the employer shall, provided the apprentice gains a pass at the annual examinations in the course which the apprentice is attending as part of his appren­ ticeship training, and completes 80 per cent of the possible attendances for the year, reimburse the apprentice the fees paid by the apprentice for attending the course in that year.

4. In consideration of the service of the apprentice the employer will pay the apprentice during the said term not less than the minimum rate of wage prescribed from time to time by the appropriate legislation, industrial awards, orders, or industrial agreements applicable to the apprentice.

5.   It is hereby agreed and declared between the parties hereto—

(a) That this indenture shall not be cancelled except in accordance with the provisions
of the Apprenticeship Ordinance 1936-1974.

(b)

That the guardian shall be bound by this indenture until the apprentice attains thi age of twenty-one years or until the expiration of the said term whichever first occurs.
