Regulations under the Advisory Council

Ordinance 1936-1938.*

*-, pursuance of the powers conferred by the Advisory Council
Ordinance 1936-1938, hereby make the following Regulations.

A M E N D M E N T O F T H E A D V I S O R Y C O U N C I L E L E C T I O N

R E G U L A T I O N S .

1. Regulation 4 of the Advisory Council Election Regulations is Aopiicntion of

(a) by omitting from paragraph (c) of sub-regulation (5.) the

word " and " ; and

(b) by adding at the end of that sub-regulation the following

paragraph:—

" and (e) the words ' the end of the period of seven days immediately succeeding' shall be deemed to be omitted from sections 92 (2.) and 96.".

2. Regulation 38 of the Advisory Council Election Regulations is

t repealed and the following Regulation is inserted in its stead :—

" 38.—(1.) The order in which the names of the candidates shall be order of

printed on the ballot-papers shall be determined as follows.— ntmeson8'

(a) The Returning Officer shall, at the place of nomination, ba,Iot"papere-

immediately after the close of nominations and before all persons present, make out in respect of each candidate a slip bearing the name of the candidate, enclose the respective slips in separate blank envelopes of exact similarity and deposit the several envelopes in a locked ballot-box;

(b) The Returning Officer shall then shake and rotate the ballot-box and shall permit any other person present, if he so desires, to do the same;

(c) The ballot-box shall then be unlocked and an officer of the Commonwealth Public Service, other than the Eeturning Officer, shall take out and open the envelopes therefrom one by one; and

(d) The name of the candidate appearing on the slip enclosed in the envelope first taken from the ballot-box shall be placed first on the ballot-papers, the name of the candidate appearing on the slip enclosed in the envelope next taken from the ballot-box shall be placed next on the ballot- papers and so on until the placing of the names of all the candidates has been determined.

(2.) Where similarity in the names of two or more candidates is likely to cause confusion, the names of such candidates may be arranged with such description or addition as will distinguish them from one ^ ^

3. Regulation 57 of the Advisory Council Election Regulations is " Provided that where the voter has indicated his first preference for one candidate and his consecutive preference* for all the remaining candidates except one and the square opposite the name of the candidate has been left blank, it shall be deemed that the voter's preference for that candidate is his last and that accordingly he has indicated the order of his preference for all the candidates.".
