Amendment Statement of Principles

concerning

PARKINSON'S DISEASE AND PARKINSONISM

No. 83 of 2010

for the purposes of the

Veterans’ Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

  1. This Instrument may be cited as Statement of Principles concerning Parkinson's disease and parkinsonism No. 83 of 2010.

  1. The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans’ Entitlements Act 1986, Statement of Principles concerning Parkinson's disease and parkinsonism Instrument No. 65 of 2007 by:

(A)Replacing part "(i)" of factor "(a)" in clause 6 with the following;

"(i)      inhaling, ingesting or having cutaneous contact with a pesticide from the specified list, on at least 250 days within a consecutive period of five years, before the clinical onset of Parkinson’s disease; or";

(B)Replacing part "(i)" of factor "(b)" in clause 6 with the following;

"(i)"     inhaling, ingesting or having cutaneous contact with a pesticide from the specified list, on at least 250 days within a consecutive period of five years, within the ten years before the clinical onset of parkinsonism; or";

(C)Replacing factor "(c)" in clause 6 with the following;

"(c)"    inhaling, ingesting or having cutaneous contact with a pesticide from the specified list, on at least 100 days within the twelve months before the clinical worsening of Parkinson’s disease or parkinsonism; or";

(D)Adding the following definition of "a pesticide from the specified list" to clause 9;

'"a pesticide from the specified list" means:

(a)a cyclodiene or hexachlorocyclohexane organochlorine insecticide;

(b)a dithiocarbamate-based fungicide;

(c)paraquat;

(d)rotenone;

(e)an organophosphorus ester; or

(f)the phenoxy acid herbicides 2,4-dichlorophenoxyacetic acid (2,4-D) or 2,4,5-trichlorophenoxyacetic acid (2,4,5-T);'.

  1. The amendment made by this instrument applies to all matters to which Instrument No. 65 of 2007, section 120A of the Veterans’ Entitlements Act 1986 and section 338 of the Military Rehabilitation and Compensation Act 2004 apply.

  1. The amendment made by this instrument takes effect from 1 September 2010.
