Amendment Statement of Principles

concerning

NEOPLASM OF THE PITUITARY GLAND

No. 46 of 2010

for the purposes of the

Veterans’ Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

  1. This Instrument may be cited as Statement of Principles concerning neoplasm of the pituitary gland No. 46 of 2010.

  1. In accordance with the Specialist Medical Review Council Declaration No. 13 of 25 February 2010 under subsection 196W(4) of the Veterans’ Entitlements Act1986 (the VEA), the Repatriation Medical Authority amends, pursuant to subsection 196B(10) of the VEA, Statement of Principles concerning neoplasm of the pituitary gland Instrument No. 42 of 2004 by:

(A)Deleting existing factors "(a)" and "(b)" from clause 5;

(B)Inserting a new factor "(a)" in clause 5 as follows:

"(a)      for ACTH secreting pituitary adenomas only, undergoing bilateral adrenalectomy before the clinical worsening of neoplasm of the pituitary gland; or";

(C)Re-numbering the existing factor "(c)" in clause 5 as "(b)"; and

(D)Replacing the existing clause 6 with the following:

"6.        Paragraphs 5(a) and 5(b) apply only to material contribution to, or aggravation of, neoplasm of the pituitary gland where the person’s neoplasm of the pituitary gland was suffered or contracted before or during (but not arising out of) the person’s relevant service.".

  1. The amendments made by this instrument apply to all matters to which Instrument No. 42 of 2004, section 120A of the Veterans’ Entitlements Act 1986 and section 338 of the Military Rehabilitation and Compensation Act 2004 apply.

  1. The amendments made by this instrument take effect from 10 March 2010.
