Amendment Statement of Principles

concerning

FIBROSING INTERSTITIAL LUNG DISEASE

No. 66 of 2012

for the purposes of the

Veterans’ Entitlements Act 1986

and

Military Rehabilitation and Compensation Act 2004

  1. This Instrument may be cited as Statement of Principles concerning fibrosing interstitial lung disease No. 66 of 2012.

  1. The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans’ Entitlements Act 1986, Statement of Principles concerning fibrosing interstitial lung disease Instrument No. 35 of 2009, as amended by Instrument No. 59 of 2010 and Instrument No. 79 of 2011, by:

A.Inserting a new factor "(nna)" immediately following factor "(nn)" in clause 6 as follows:

"(nna)    having gastro-oesophageal reflux disease for at least the five years before the clinical worsening of fibrosing interstitial lung disease; or";

B.Replacing existing factor "(t)" in clause 6 with the following:

"(t)         smoking at least 15 pack-years of cigarettes, or the equivalent thereof in other tobacco products, before the clinical onset of fibrosing interstitial lung disease, and where smoking has ceased, the clinical onset has occurred within 25 years of cessation; or"; and

C.Replacing existing factor "(nn)" in clause 6 with the following:

"(nn)      smoking at least five pack-years of cigarettes, or the equivalent thereof in other tobacco products, before the clinical worsening of fibrosing interstitial lung disease, and where smoking has ceased, the clinical worsening has occurred within five years of cessation; or".

  1. The amendment made by this instrument applies to all matters to which Instrument No. 35 of 2009, as amended by Instrument No. 59 of 2010 and Instrument No. 79 of 2011, section 120A of the Veterans’ Entitlements Act 1986 and section 338 of the Military Rehabilitation and Compensation Act 2004 apply.

  1. The amendment made by this instrument takes effect from 5 September 2012.
