s1 2 s4 Ambulance Service Amendment (No. 2) No. 333, 1998 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Ambulance Service Amendment Regulation (No. 2) 1998 . ˙ Commencement 2.(1) Part 2 is taken to have commenced on 2 November 1998. (2) Part 3 commences on 1 January 1999. ˙ Regulation amended 3. This regulation amends the Ambulance Service Regulation 1991 . PART 2—PROVISIONS COMMENCED ON 2 NOVEMBER 1998 ˙ Insertion of new s 4A 4. After section 4— insert ˙ Certain persons exempt from payment of charges for the use of ambulance services—Act, s 2, definition “subscriber” 4A.(1) The following persons and their families are exempt from the payment of charges for the use of ambulance services— (a) service officers; (b) honorary ambulance officers. (2) However, subsection (1)(a) does not apply to— (a) a service officer who is a casual employee; or
s5 3 s6 Ambulance Service Amendment (No. 2) No. 333, 1998 (b) a service officer who— (i) is a temporary employee; and (ii) has not been engaged for a continuous period of 6 months; and (iii) is not engaged for a fixed term of at least 6 months.’. ˙ Amendment of s 5 (Entitlements) 5. Section 5(2)— omit, insert (2) However, a fee is payable for first aid, treatment, care or transport if the subscriber has been a subscriber for less than 14 days unless— (a) the first aid, treatment, care or transport arises from an accident or unexpected emergency that happened after the receipt of the subscription; or (b) the subscriber is a person who is exempt from the payment of charges for the use of ambulance services.’. PART 3—PROVISIONS COMMENCING ON 1 JANUARY 1999 ˙ Amendment of s 3 (Definitions) 6.(1) Section 3, definitions “child”, “family” and “pensioner”— omit. (2) Section 3— insert— “child” , of a person, includes a stepchild or foster child of the person. “dependant” see section 3A. “family” , of a subscriber, means—
s7 4 s7 Ambulance Service Amendment (No. 2) No. 333, 1998 (a) the subscriber’s spouse; and (b) dependants of the subscriber residing with the subscriber or the subscriber’s spouse. “pensioner” means a person who is the holder of— (a) a Commonwealth pensioner concession card; or (b) a Queensland seniors card. “spouse” , of a person, includes someone in a de facto relationship with the person. “student” means a full-time student at an educational institution. “veteran” means a person who is the holder of— (a) Repatriation health card—for all conditions (gold card); or (b) Repatriation health card—for specific conditions (white card).’. (3) Section 3, definition “member”, ‘state education’— omit, insert— ‘State educational’. (4) Section 3, definition “state education institution”, ‘state education’— omit, insert— ‘State educational’. ˙ Insertion of new s 3A 7. After section 3— insert— ˙ Meaning of “dependant” 3A.(1) A person is a “dependant” of a subscriber if the person is— (a) a dependent child of the subscriber; or (b) a dependent child of the subscriber’s spouse; or (c) listed as a dependant on a Commonwealth pensioner concession card held by the subscriber.
s8 5 s9 Ambulance Service Amendment (No. 2) No. 333, 1998 (2) However, for subsection (1)— (a) a student is taken not to be a dependent child of a subscriber or a subscriber’s spouse if— (i) the student is at least 25 years old; or (ii) the student’s taxable income for the previous financial year was more than $5 400.00; and (b) a non-student is taken not to be a dependent child of a subscriber or a subscriber’s spouse if— (i) it is after 1 March following the non-student’s seventeenth birthday; or (ii) the non-student’s taxable income for the previous financial year was more than $1 786.00.’. ˙ Amendment of s 4 (Subscriptions) 8. Section 4(1), (2) and (4), ‘pensioner’— omit, insert ‘veteran’. ˙ Amendment of s 4A (Certain persons exempt from payment of charges for the use of ambulance services—Act, s 2, definition “subscriber”) 9.
