P reliminary . Short title. 1. This Act may be cited as The Aliens Acts and Another Act Amendment Act of 1952.” Parts of Act. 2 . This Act is divided into Parts, as follows :— P art I. —P reliminary ; P art II. —A mendments of *“ T he A liens A cts , 1867 to 1948 ” ; P art III. —A mendments of f“ T he L eases to A liens R estriction A cts , 1912 to 1948 ; P art IV. —G eneral . P art II.— A mendments of “ T he P art A liens A cts , 1867 TO 1948.” II. —A mendments of *“ T he to 1948.” A liens A cts , 1867 Collective title. 3. This Part of this Act shall be read as one with *“ The Aliens Acts, 1867 to 1948,” and those Acts and this Part may collectively be cited as The Aliens Acts, 1867 to 1952.” Amendments Section three of *“ The Aliens Acts, 1867 to 1948,” is 3o1f sV. ic3. oNfo. amended as follows :— 28. P art II.— A mendments of “T he A liens A cts , 1867 TO 1948.” (b) The second paragraph of that section is repealed; (c) The following subsection is added to that section, namely :— (2.) (a) In this subsection the term “ Minister ” means the Attorney-General or other Minister for the time being charged with the administration of this Act. ( b ) Any and every alien shall and may— (i.) Notwithstanding any provision of any other Act or law ; but (ii.) As respects real property or chattels real, subject to the Minister permitting him in writing to take real property, take and hold by purchase, gift, bequest, representation, or otherwise every species of property, real and personal, movable and immovable, as fully and effectually to all intents and purposes and with the same rights, remedies, exemptions, privileges, and capacities as if he or she were a British subject under and within the meaning of the * NationalityandCitizenship Act1948-1950 of the Commonwealth (or of any Act passed in amendment thereof or substitution therefor). (c) The Minister may— (i.) Refuse to grant to an alien a permit under this subsection without assigning any reason for so doing; (ii.) Require an applicant for a permit under this subsection to furnish to him all such information and particulars as he deems necessary in the circumstances, and further require any information or particulars so furnished to be verified as he shall direct; (iii.) Grant to an alien a permit under this subsection in respect of any specified real property or chattel real, or any specified estate or interest in real property or chattels real or any specified estate or interest in any specified real property or chattel real. (d) A permit granted to an alien under this subsection in respect of any specified real property or chattel real, or any specified estate or interest in any real property or chattels real, or any specified estate or * No. 83, 1948.

No. 22, A liens A cts , 1867 to 1948.’* interest in any specified real property or chattel real, shall limit the right of that alien so that he shall be authorised by this subsection to take and hold the particular real property, chattel real, or, as the case may be, estate or interest in real property or chattels real or in the particular real property or chattel real as specified in the permit and none other. ( e) The Minister may revoke any permit granted by him under this section, but the revocation by the Minister of the permit shall not affect or prejudice howsoever the right of the alien in question to continue to hold any real property, chattels real or estate or interest in any real property or chattels real lawfully taken by that alien before, and lawfully held by him when, the permit is revoked, or affect or prejudice howsoever any of the rights, remedies, exemptions and capacities had by that alien in relation to the same by virtue of this subsection. (/) The power of the Minister to revoke a permit granted by him under this section shall include power to revoke, by a notice published in the Gazette all permits so granted by him to citizens or subjects of any State or Country specified in that notice, it being hereby declared that all such permits to citizens or subjects of a State or Country specified in such a notice of revocation granted before and in force at the date of the publication of that notice in the Gazette shall be thereby revoked, notwithstanding that such notice does not name or otherwise identify those citizens or subjects or any of them.” Amendment 4-. Section four of *“ The Aliens Acts, 1867 to 1948,” No31fos. V. 2i4c8.. of iasndambeyndinedserbtiyng,reipnealliienug otfhethlaatstreppaeraalegdrappharatghrearpeho, f the following paragraph, namely :— “ This section shall be read so as not to limit the right of an alien to take and hold any lands, houses or other tenements, or any estate or interest therein which he may lawfully take and hold under and by virtue of the provisions of section three of this Act or to continue to hold any lands, houses or other tenements, or any estate or interest therein, lawfully taken by him under and by virtue of the provisions of the said section three as in force immediately prior to the passing of The Aliens Acts and Another Act Amendment Act of 1952”. ” * 31 V. ALIENS. 17 P art III.— 1952. Aliens Acts, Etc., Amendment Act. A mendments of “ T he L eases to A liens R estriction III. P art —A mendments op *“ T he L eases to A liens 1912 io T1948.’' R estriction A cts , 1912 to 1948.” 5. This Part of this Act shall be read as one with title *“ The Leases to Aliens Restriction Acts, 1912 to 1948,” construction, and those Acts and this Part of this Act may collectively be cited as The Leases to Aliens Restriction Acts, 1912 to 1952.” 6 . Section three of *“ The Leases to Aliens Restriction ^j6I^eab Acts, 1912 to 1948,” is amended by repealing subsection 2 Geo. v. four thereof and by inserting, in lieu of that repealedNo- 31- subsection, the following subsection, namely :— (4.) This section shall not apply in respect of any transaction relating to land to which an alien is a party which when entered into was lawful under and by virtue of the provisions of f“ The Aliens Acts, 1867 to 1948,” as in force immediately prior to the passing of The Aliens Acts and Another Act Amendment Act of 1952, ” or which is lawful under and by virtue of the provisions of f “The Aliens Acts, 1867 to 1952,” excepting that such a transaction shall be taken into account for the purposes of determining whether or not any further transaction (not lawful under and by virtue of the provisions either of The Aliens Acts, 1912 to 1948,” as in force immediately prior to the passing of The Aliens Acts and Another Act Amendment Act of 1952,” or of The Aliens Acts, 1912 to 1952 ”) is unlawful under and by virtue of the provisions of subsection tw'O of this section.” P art IV.— G eneral . pgmbral . 7. Section eight of §“The Aliens Act and Another Repeal of Act Amendment Act of 1948,” is repealed. 13 G°eo. yi. No. 10. 8. 18 P art IV.— G eneral . ALIENS—ANIMALS. Animals Protection Act Amendment Act. 1 E liz . II. No. 44, of property, real or personal, movable or immovable, shall be read subject to this Act so that such prohibition, disqualification, restriction, or limitation shall not— (a) Prejudice or affect otherwise the right of an alien to continue to hold any property of the species in question lawfully taken by him before the passing of this Act under and by virtue of the provisions of *“ The Aliens Acts, 1867 to 1948,” as in force immediately prior to the passing of this Act; or (b) Prevent, prejudice or affect otherwise the taking or holding by an alien of any property of the species in question which he may lawfully take and hold under and by virtue of the provisions of *“The Aliens Acts, 1867 to 1952.” ANIMALS. 1 N E o l . iz 4 . 4 I . By repealing the definition of the term “ Animal ” in that section and by inserting the following definition in lieu of that repealed definition :— Animal. “ Animal ”—Any animal or bird of whatsoever species whether in a natural or domestic state : The term includes any domestic or captive animal;”. * 31 V.
