The Court found that the Acting Assistant Director's decision was not subject to judicial review as it was an internal decision-making process and not a decision made under the Act. In addition, the Court found that the Minister had the discretion to decide whether or not to consider exercising the power under s 417 and that this decision was not subject to judicial review. Accordingly, the Court found that Alfred had no reasonable prospects of success in his application for judicial review and granted summary judgment in favour of the Minister. The Court further ordered that Alfred pay the Minister's costs of and incidental to the summary judgment application, to be fixed in a lump sum.
