Neither of the grounds of appeal proposed by this application for special leave to appeal presents an issue of law as distinct from an invitation to this Court to review the factual findings of the primary judge. In addition, the applicant's prospects of success on the proposed appeal are not such as to warrant the grant of special leave to appeal. Special leave should be refused.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
