Alexander Vonidis v BMW Australia Finance Limited (ACN 007 101 715)

Case

[2011] HCASL 155

ALEXANDER VONIDIS
v
BMW AUSTRALIA FINANCE LIMITED (ACN 007 101 715)
[2011] HCASL 155
M59/2011

  1. The applicant seeks special leave to appeal against the orders of a single judge of the Federal Court of Australia (Foster J) dismissing the applicant's appeal against orders made by the Federal Magistrates Court.  The Federal Magistrate (Burchardt FM) had dismissed the applicant's application for orders setting aside the sequestration order made against his estate or annulling his bankruptcy.

  2. There is no reason to doubt the correctness of the decision of Foster J.

  3. After notice was given to the applicant that the application was listed for pronouncement of orders and publication of reasons, a solicitor, Starnet Legal Pty Ltd, filed a notice that it acted for the applicant and a notice of constitutional matter, signed by the applicant personally, was filed.  Despite these steps we are of the opinion that the application should be determined now.

  4. Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application.
