I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance

of section 2 of the Albury-Wodonga Development (Amendment) Act

1991, do, by this my Proclamation, appoint 21 February 1992 as the day on which items (3) (a), (12), (15), (16), (22), (25) and (26) of Schedule 1

to that Act, and section 3 in its application to those provisions,

commence.

EXPLANATORY NOTE

Item (3) (a) of Schedule 1 replaces the definition of “Agreement” in section 4 of

the Albury-Wodonga Development Act 1974, item (12) repeals section 17 (2), item

(15) repeals and replaces section 22, item (16) repeals section 23, item (22) inserts

section 46, item (25) inserts Schedule 3A and item (26) repeals the existing
Schedule 4 to the Act.

The new definition of “Agreement” is inserted as a consequence of amendments made to the Albury-Wodonga Area Development Agreement.

1992—No. 70

The repealed section 17 (2) of the Act allowed the now-defunct State Planning

Authority to undertake work on behalf of the Albury-Wodonga (New South Wales)
Corporation.

The new section 22 authorises the Albury-Wodonga Development Corporation:

• to carry out investigations and studies; and
• to consult with authorities and bodies on any environmental planning

matter; and

• to advise those authorities and bodies with respect to regional planning

issues.

The result of the repeal of section 23 is that the planning powers of the

Albury-Wodonga Development Corporation revert to the Albury City Council and the Hume Shire Council. The repeal renders Schedule 4 (Modification of the Environmental Planning and Assessment Act 1979) redundant. Accordingly, that
Schedule is repealed by item (26).

The new Schedule 3A is a Schedule of savings and transitional provisions which,

in the main, relate to the transfer of planning powers form the Albury-Wodonga Development Corporation to the Albury City Council and the Hume Shire Council.
Section 46 is a formal provision giving effect to that Schedule.
