Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Albury Local Environmental Plan 2000 (Amendment

No 10—Hamilton Valley).

2      Aims of plan

This plan aims:

(a)

to rezone part of the land to which this plan applies from partly the Urban Fringe Zone and partly the Living Area Zone to the Environment Protection Zone under Albury Local Environmental Plan 2000 (the 2000 plan), and

(b)

to rezone part of the land from partly the Urban Fringe Zone and partly the Environment Protection Zone to the Living Area Zone under the 2000 plan, and

(c)

to set development controls that relate to residential development of part of the land.

3      Land to which plan applies

This plan applies to certain land at Hamilton Valley, as shown edged heavy black on the map marked “Albury Local Environmental Plan 2000 (Amendment No 10—Hamilton Valley)” deposited in the office of Albury City Council.

4 Amendment of Albury Local Environmental Plan 2000

Albury Local Environmental Plan 2000 is amended as set out in

Schedule 1.

Insert after clause 18 (3):

Despite subclauses (1) and (2), a dwelling-house must not be erected on any allotment of land that has an area of less than 1 hectare within the Centaur Road area (shown on the map by stippling).

(5)

A person must not carry out development for the purpose of medium density housing or integrated housing within the Centaur Road area (shown on the map by stippling).
