This application does not raise a question of sufficient general importance to warrant the grant of special leave but concerns a question of practice and procedure relating to costs.  In addition there is no reason to doubt that the decision of the Court of Appeal of the Supreme Court of Victoria was correct.

2. Pursuant to r 41.11.1, we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
