Airports (Environment Protection) Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Airports Act 1996.

1.   Commencement

1.1   These Regulations commence on gazettal.

2.   Amendment

2.1   The Airports (Environment Protection) Regulations are amended as set out in these Regulations.

3.   New regulation 1.03A

3.1   After regulation 1.03, insert:

Airports to which Division 3 of Part 6 of the Act applies

 “1.03A. For paragraph 131A (b) of the Act, the following airports are specified:

  • (a)

    Archerfield Airport;

  • (b)

    Essendon Airport;

  • (c)

    Jandakot Airport;

  • (d)

    Moorabbin Airport;

  • (e)

    Parafield Airport.”.

4.   Regulation 1.05 (Definitions)

4.1   Add at the end:

(2) An expression used in both these Regulations and the Airports Regulations has, unless the contrary intention appears, the same meaning in these Regulations as in those Regulations.”.

5.   Regulation 3.01 (Application)

5.1   Omit the regulation, substitute:

Airports to which Division 2 of Part 6 of the Act applies

 “3.01. For paragraph 114 (b) of the Act, the following airports are specified:

  • (a)

    Archerfield Airport;

  • (b)

    Essendon Airport;

  • (c)

    Jandakot Airport;

  • (d)

    Moorabbin Airport;

  • (e)

    Parafield Airport.

Application of this Part

 “3.01A.This Part applies to each draft, and final, environment strategy for an airport, prepared under Division 2 of Part 6 of the Act.”.

6.   Regulation 8.03 (Infringement notices)

6.1   Subparagraph 8.03 (2) (i) (iii):

Omit “.”, substitute “;”.

7.   New regulation 10.07

7.1   After regulation 10.06, insert:

Delegation

 “10.07.The Secretary may, by instrument, delegate to a Senior Executive Service officer performing duties in the Department any of the Secretary’s powers under these Regulations, other than this power of delegation.”.
