Airports (Control of On-Airport
Activities) Regulations2
(Amendment)
I, The Governor-General of the Commonwealth of Australia,
acting with the advice of the Federal Executive Council, make the following
Regulations under the Airports Act 1996.

1. Commencement
1.1 These
Regulations commence on 1 July 1997.
2. Amendment
2.1 The Airports
(Control of On-Airport Activities) Regulations are amended as set out in these
Regulations.
3. Regulation 1.03 (Definitions)
3.1 Insert:
“‘infringement notice offence’ means a contravention
of these Regulations for which an infringement notice may be issued.
[Note:
The Note following regulation 1.03 should be
amended by omitting “Note:” and substituting “Note 2:”].
4. Regulation 2.31 (Definitions for Division)
4.1 Definition of “existing authorisation”:
Omit the definition, substitute:
“‘existing authorisation’ means an authority
(however described and however granted, and including an authority that is part
of the terms of a lease, sublease, licence or sublicence) given before the
commencement of this regulation, and in effect immediately before that commencement,
for a person to sell or supply liquor at premises within Melbourne Airport;”.
5. Regulation 2.41 (Definitions for Division)
5.1 Definition of “existing authorisation”:
Omit the definition, substitute:
“‘existing authorisation’ means an authority
(however described and however granted, and including an authority that is part
of the terms of a lease, sublease, licence or sublicence) given before the
commencement of this regulation, and in effect immediately before that commencement,
for a person to sell or supply liquor at premises within Brisbane Airport;”.
6. Regulation 2.61 (Definitions for Division)
6.1 Definition of “existing authorisation”:
Omit the definition, substitute:
“‘existing authorisation’ means an authority
(however described and however granted, and including an authority that is part
of the terms of a lease, sublease, licence or sublicence) given before the
commencement of this regulation, and in effect immediately before that commencement,
for a person to sell or supply liquor at premises within Perth Airport;”.
7. Regulation 7.03 (Service of infringement
notices)
7.1 Add at the end:
“(4) An infringement notice for a contravention of
regulation 4.06 or 4.07 is taken to have been served on both the owner of the
vehicle concerned and the person who was the driver of the vehicle at the
relevant time, if the authorised person who issues the notice attaches it to,
or places it under a windscreen wiper of, the vehicle.”.
8. Schedule 1 (Modifications of State liquor
legislation)
8.1 Part 2 (Liquor Control Act 1987 of
Victoria):
Item 15:
Omit the item, substitute:
“15. Section
101 (Cancellation and suspension)
“15.1 Sub-section 101 (2):
“Omit the sub-section.
“15.2 Sub-section 101 (3):
“Omit the sub-section, substitute:
‘(3) However, if a licensing inspector considers
that a licensee or permittee is not a suitable person to hold the licence or
permit or extended hours permit, the licensing inspector may apply to the
Commission for the cancellation or suspension of the licence or permit or
extended hours permit.’.
“15.3 Sub-section 101 (4):
“Omit ‘, (2)’.”.
