Aircraft Noise Levy Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Aircraft Noise Levy Act 1995 and the Aircraft Noise Levy Collection Act 1995.

1.   Amendment

1.1   The Aircraft Noise Levy Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 9 (How must levy and late-payment penalty be paid?)

2.1   Paragraph (9) (3) (b):

Omit “each bank account approved under subregulation (2);”, substitute “each approved bank account;”.

 

2.2   Subregulation 9 (4) (definition of “approved bank account”):

Omit the definition, substitute:

 “‘approved bank account’ means a bank account approved under regulation 10;”.

2.3   Subregulation 9 (5):

  • Omit the subregulation. 

3.   New Regulation 10

3.1   Add at the end:

What is an approved bank account?

 “10. (1) For the purposes of subregulation 9 (2), an authorised person may approve, in writing, a bank account as a bank account in which a payment of levy or late-payment penalty may be deposited, or to which a payment of that kind may be transferred, by a person who is liable, or may be liable, for the payment of levy or late-payment penalty. 

 “(2) In this regulation:

‘authorised person’ means:

  • (a)

    the Minister for Finance; or

  • (b)

    a person authorised by the Minister for Finance.”.
