REGULATIONS UNDER THE AIR NAVIGATION ACT 1920-1936.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Navigation Act 1920-1936.

Amendment of Air Navigation Regulations. 

After regulation 103 of the Air Navigation Regulations the following regulations are inserted:—

Contempt of Committee.

“103a. Any person who wilfully insults or disturbs the Committee, or interrupts the proceedings of the Committee, or uses any insulting language towards the Committee, or by writing or speech uses words false and defamatory of the Committee, or is in any manner guilty of any wilful contempt of the Committee shall be guilty of an offence.

Protection of members of Committee and witnesses.

“103b.— (1.) Every member of the Committee shall, in the exercise of his duty as such member, have the same protection and immunity as a Justice of the High Court.

“(2.) Every witness summoned to attend or appearing before the Committee shall have the same protection, and shall be subject to the same liabilities in any civil or criminal proceeding, as a witness in any case tried in the High Court.

Action or information not maintainable against a person for faithfully reporting.

“103c. An action or information shall not be maintainable against any person for publishing a faithful and accurate report of proceedings in any inquiry before the Committee:

Provided that it shall not be lawful to publish any matter of an obscene or blasphemous nature, nor any proceedings in any inquiry before the Committee which are not concluded and which the Chairman pronounces it improper to publish at that stage.”.
