Air Navigation Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Air Navigation Act 1920.

1.   Amendment

1.1   The Air Navigation Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48]

2.   Regulation 311d (Aircraft flying to or from Iraq—prohibition)

2.1   Subregulations 311d (4), (5) and (6):

Omit the subregulations, substitute:

“(4)

When deciding whether to give approval under subregulation (1), (2) or (3), the Secretary must take into account Australia’s relations with other countries and its obligations under international law.”.

3.   New regulation 311e

3.1   After regulation 311d, insert:

Aircraft flying to or from Libya—prohibition

 “311e. (1)  An Australian aircraft must not travel to or from Libya without the express approval of the Secretary.

“(2)

An aircraft that, after the commencement of this regulation:

(a)

leaves Libyan territory; or

(b)

is destined to land in Libyan territory;

must not be landed in, flown over or flown from, Australian territory without the express approval of the Secretary.

“(3)

When deciding whether to give approval under subregulation (1) or (2),  the Secretary must take into account Australia’s relations with other countries and its obligations under international law.

“(4)

The requirements of this regulation are in addition to the requirements of regulation 192.

“(5)

In this regulation, ‘Libya’ means the Socialist People’s Libyan Arab Jamahiriya.”.
