Air Navigation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Navigation Act 1920.

Commencement

1. These Regulations commence on 1 January 1990.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Air Navigation Regulations.

Interpretation

3. Regulation 5 of the Principal Regulations is amended by inserting in subregulation (1) the following definitions:

‘designated airport’ means an airport specified in a notice under regulation 309;

‘protective service officer’ means a protective service officer, and a special protective service officer, within the meaning of the Australian Protective Service Act 1987;”.

4. After the heading to Part xvia of the Principal Regulations the following heading is inserted:

Division 1Aviation Security and International Air Services”.

5. After Division 1 of Part XVIa of the Principal Regulations the following Division is inserted:

Division 2Aviation Security: General

Designated Airports

“309. The Secretary may, by notice published in the Gazette,specify an aerodrome as a designated airport for the purposes of this Division.

Protective services officers may enter designated airports

“310. A protective services officer, while exercising powers or performing functions under the Australian Protective Service Act 1987,may enter and remain in, any part of a designated airport.

Authorised persons—appointment etc.

“311. (1) The Secretary may, in writing, appoint an officer of the Department to be an authorised officer for the purposes of this division.

“(2) The Secretary must issue to an authorised officer an identity card that:

(a) shows a recent photograph of the person; and

(b) states that the holder of the card is an authorised officer for the purposes of this Division.

“311a. A person who stops being an authorised officer must return his or her identity card to the Secretary.

Penalty: $100.

Proof of authority

“311b. An authorised officer is not entitled to exercise powers under this Division in relation to a person unless the authorised officer has first produced his or her identity card for inspection by the person.

Authorised officers—entry and inspection

“311c. (1) An authorised officer may enter, and remain in, any part of a designated airport for the purposes of ensuring that aviation is safeguarded against unlawful interference.

“(2) An authorised officer who enters part of a designated airport may:

(a) inspect buildings and equipment; and

(b) observe operating procedures in relation to aircraft operations carried out at the airport; and

 

(c) observe measures taken by operators of aircraft or occupiers of all or part of the airport;

for the purposes of ensuring that aviation is safeguarded against unlawful interference.
