Air Navigation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Navigation Act 1920.

1. Commencement

1.1 These Regulations commence on 1 October 1990.

2. Amendment

2.1 The Air Navigation Regulations are amended as set out in these Regulations.

3. Regulation 246 (Smoking in aircraft)

3.1 Subregulation 246 (10):

Omit the definition of “prescribed aircraft”, substitute:

‘prescribed aircraft’ means a regular public transport aircraft that:

(a) is engaged in a public transport service between aerodromes in Australian territory; and

(b) is:

(i) in the case of an Australian aircraft—an aircraft operated by a trading corporation; or

(ii) in the case of a foreign aircraft—an aircraft that is in Australian territory.”.
