Air Navigation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Air Navigation Act 1920.

1.   Commencement

1.1   These Regulations commence on 1 March 1995.

2.   Amendment

2.1   The Air Navigation Regulations are amended as set out in these Regulations.

3.   Regulation 246 (Smoking in aircraft)

3.1   Subregulation 246 (10) (definition of “prescribed aircraft”):

Omit the definition, substitute:

“ ‘prescribed aircraft’ means:

  • (a)

    a regular public transport aircraft that:

    • (i)

      is engaged in a public transport service between aerodromes in Australian territory; and

    • (ii)

      is:

      • (A)

        in the case of an Australian aircraft—an aircraft operated by a trading corporation; or

      • (B)

        in the case of a foreign aircraft—an aircraft that is in Australian territory; or

  • (b)

    an Australian aircraft that is engaged in:

    • (i)

      an international air service; or

    • (ii)

      a charter operation within the meaning of paragraph 5 (2) (b);

 for the carriage of passengers from a point in a country specified in Schedule 1A to a point in another country specified in Schedule 1A, other than a flight that stops at an intermediate point in a country not specified in that Schedule;”.

4.1   After Schedule 1, insert:
