REGULATIONS UNDER THE AIR NAVIGATION ACT 1920.

I, THE person administering the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Air Navigation Act 1920, to come into oprtaion forthwith.

Amendment of Air Navigation Regulations.

(Statutory Rules 1921, No. 33, as amended to this date.)

1. Regulation 3 of the Air Navigation Regulations is amended by inserting at the end of the definition of “Passenger aircraft” the following words:—

“and aircraft used or intended for use for the purpose of enabling persons to learn and practice the art of flying”.

2. Regulation 7 of the Air Navigation Regulations is amended by adding at the end of paragraph (a) the following sub-paragraph:—

“or (iii) be flown by any person who is not licensed in the prescribed manner to fly such aircraft;”.

3. Regulation 20 of the Air Navigation Regulations is omitted and the following regulation inserted in its stead :—

Cancellation or suspension of registration.

“20.—(1.) The Minister may—

(a) cancel, or suspend for such period, as he thinks fit, the registration of any aircraft if, in his opinion, sufficient reason exists for such cancellation or suspension; and

(b)remove the suspension of any such registration if, in his opinion, a reason for the suspension thereof no longer exists.

(2.) On the cancellation under this regulation of the registration of an aircraft, any certificate of registration granted in respect of the aircraft shall become void.

(3.) During the period of suspension under this regulation of the registration of an aircraft, any certificate of registration granted in respect of the aircraft shall be void.”.

4. Regulation 26 of the Air Navigation Regulations is amended by adding at the end thereof the following sub-regulation:—

“(2.) Any pilot who makes a flight in any aircraft which does not comply with any condition contained in the certificate of airworthiness shall be guilty of an offence.”.

5. After regulation 96 of the Air Navigation Regulations the following regulation is inserted:—

Proof of licences, &c.

“96a.— (1.) In any proceedings in any Court—

(a) any certificate, notice or other document bearing the written, stamped or printed signature of the Controller of Civil Aviation shall until the contrary is proved be deemed to have been duly signed by the person by whom it purports to have been signed; and

(b) any such certificate certifying to—

(i) the registration or non-registration, suspension or cancellation of registration of any aircraft;

(ii) the issue or non-issue, suspension or cancellation of the Certificate of Airworthiness of any aircraft;

(iii) the licensing or non-licensing, suspension or cancellation of licences of personnel; and

(iv) the licensing or non-licensing of aerodromes,

shall be prima facie evidence of the facts stated in the certificate.

“(2.) Judicial notice shall be taken of such signature and of the fact that the person whose signature it purports to be holds or has held the office of Controller of Civil Aviation.”
