Air Navigation (Charges) Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Air Navigation (Charges) Act 1952.

After regulation 2 of the Air Navigation (Charges) Regulations, the following regulation is inserted:

Prescribed circumstance in relation to remission and refund of penalty

“2a. (1) For the purposes of section 5a of the Act, the following circumstance is a prescribed circumstance in relation to an amount by way of penalty under sub-section 5 (2) of the Act in respect of a charge due and payable under Schedule 2 to the Act in relation to an aircraft, namely, that the charge is in respect of a year of registration in relation to the aircraft that expires on or after 1 July 1986.

“(2) In sub-regulation (1), “year of registration”, in relation to an aircraft, has the same meaning as in paragraph 2 of Schedule 2 to the Act.”.
