1Name of Regulations

These Regulations are the Air Navigation Amendment Regulations 2003 (No. 2).

2Commencement

These Regulations commence on gazettal.

3Amendment of Air Navigation Regulations 1947

Schedule 1 amends the Air Navigation Regulations 1947.

Division 3AAdvertising non-scheduled flights

24ARestriction on advertising non-scheduled flights

  1. (1)

    A person must not, unless subregulation (2) is satisfied, advertise or make a public announcement to the effect that the person is willing to:

    1. (a)

      sell seats on a non-scheduled flight; or

    2. (b)

      make capacity available on a non-scheduled flight.

Penalty: 10 penalty units.

  1. (2)

    This subregulation is satisfied if:

    1. (a)

      the Secretary has:

      1. (i)

        granted permission for the flight under section 15D of the Act; or

      2. (ii)

        determined, under subsection 15A (3) or 17 (1B) of the Act, that permission for the flight is not required; or

    2. (b)

      the advertisement or public announcement states that the operation of the non-scheduled flight is subject to Government approval.

Note Non-scheduled flight is defined in section 3 of the Act.
